1 AMENDMENT TO SENATE BILL 2570
2     AMENDMENT NO. ______. Amend Senate Bill 2570, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:

5     "Section 5. The Illinois Highway Code is amended by adding
6 Section 4-106 as follows:

7     (605 ILCS 5/4-106 new)
8     Sec. 4-106. Misrepresentation.
9     (a) In relation to the submission of plans, maps,
10 specifications, costs of construction, bids, or contracts for
11 any Department project, it is unlawful for the Department, its
12 employees and its agents to knowingly falsify, distort, or
13 misrepresent any facts concerning, but not limited to, the
14 following:
15         (1) the character, quality, cost, or quantity of
16     material already used or to be used;

1         (2) the quality or quantity of any work already
2     performed or to be performed; and
3         (3) any other related costs.
4     (b) A violation of subsection (a) of this Section shall be
5 punishable by a fine of not more than $10,000 or by
6 imprisonment of not more than 5 years, or both. ".
