AMENDMENT TO SENATE BILL 2300

2    AMENDMENT NO. ______. Amend Senate Bill 2300, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Lead Poisoning Prevention Act is amended by
6changing Section 9.1 as follows:
 
7    (410 ILCS 45/9.1)  (from Ch. 111 1/2, par. 1309.1)
8    Sec. 9.1. Owner's obligation to give notice. An owner of a
9regulated facility who has received a mitigation notice under
10Section 9 of this Act shall, before entering into a new lease
11agreement or sales contract for the dwelling unit for which the
12mitigation notice was issued, provide prospective lessees or
13purchasers of that unit with written notice that a lead hazard
14has previously been identified in the dwelling unit, unless the
15owner has obtained a certificate of compliance for the unit
16under Section 9. An owner may satisfy this notice requirement

1by providing the prospective lessee or purchaser with a copy of
2the inspection report prepared pursuant to Section 9. An owner
3of a regulated facility who has received a mitigation notice
4under Section 9 of this Act shall, before entering into a new
5lease agreement for the dwelling unit for which the mitigation
6notice was issued, mitigate the lead hazard previously
7identified in the regulated facility and obtain a certificate
8of compliance under Section 9.
9    Before entering into a residential lease agreement or sales
10contract, all owners of regulated facilities containing
11dwelling units built before 1978 shall give prospective lessees
12or purchasers information on the potential health hazards posed
13by lead in regulated facilities by providing prospective
14lessees or purchasers with a copy of an informational brochure
15prepared by the Department and shall be consistent with the
16requirements set forth in 40 CFR Part 745, Subpart F.

18    Section 99. Effective date. This Act takes effect January
191, 2017.".
