AMENDMENT TO SENATE BILL 1906

2    AMENDMENT NO. ______. Amend Senate Bill 1906 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Sections 5.866 and 5.867 as follows:
 
6    (30 ILCS 105/5.866 new)
7    Sec. 5.866. The U.S.S. Illinois Commissioning Fund. This
8Section is repealed on December 31, 2017.
 
9    (30 ILCS 105/5.867 new)
10    Sec. 5.867. The Autism Care Fund.
 
11    Section 10. The Illinois Income Tax Act is amended by
12adding Section 507DDD, 507EEE, and 507FFF as follows:

1    Sec. 507DDD. Special Olympics Illinois and Special
2Children's Checkoff. For taxable years beginning on or after
3January 1, 2015, the Department shall print on its standard
4individual income tax form a provision indicating that if the
5taxpayer wishes to contribute to the Special Olympics Illinois
6and Special Children's Charities Checkoff Fund as authorized by
7this amendatory Act of the 99th General Assembly, he or she may
8do so by stating the amount of the contribution (not less than
9$1) on the return and that the contribution will reduce the
10taxpayer's refund or increase the amount of payment to
11accompany the return. Failure to remit any amount of increased
12payment shall reduce the contribution accordingly. This
13Section shall not apply to an amended return. For the purpose
14of this Section, the Department of Revenue must distribute the
15moneys as provided in 21.9(b) of the Illinois Lottery Law: (i)
1675% of the moneys to Special Olympics Illinois to support the
17statewide training, competitions, and programs for future
18Special Olympics athletes; and (ii) 25% of the moneys to
19Special Children's Charities to support the City of
20Chicago-wide training, competitions, and programs for future
21Special Olympics athletes.
 
22    (35 ILCS 5/507EEE new)
23    Sec. 507EEE. U.S.S. Illinois Commissioning Fund checkoff.
24For taxable years ending on or after December 31, 2014 and
25ending on or before December 31, 2016, the Department must

1print on its standard individual income tax form a provision
2(i) indicating that if the taxpayer wishes to contribute to the
3U.S.S. Illinois Commissioning Fund, a special fund created in
4the State treasury, for the purpose of donating to the U.S.S.
5Illinois Commissioning Committee, as authorized by this
6amendatory Act of the 99th General Assembly, he or she may do
7so by stating the amount of the contribution (not less than $1)
8on the return and (ii) stating that the contribution will
9reduce the taxpayer's refund or increase the amount of payment
10to accompany the return. Failure to remit any amount of
11increased payment shall reduce the contribution accordingly.
12Notwithstanding any other provision of law, moneys deposited
13into the U.S.S. Illinois Commissioning Fund from contributions
14under this Section shall be used by the Department of Military
15Affairs to make grants to the U.S.S. Illinois Commissioning
16Committee. This Section does not apply to any amended return.
17    This Section is repealed on December 31, 2017.

19    Sec. 507FFF. Autism Care Fund checkoff. For taxable years
20ending on or after December 31, 2015, the Department must print
21on its standard individual income tax form a provision (i)
22indicating that if the taxpayer wishes to contribute to the
23Autism Care Fund, a special fund created in the State treasury,
24for the purpose of donating to the Autism Society of Illinois,
25as authorized by this amendatory Act of the 99th General

1Assembly, he or she may do so by stating the amount of the
2contribution (not less than $1) on the return and (ii) stating
3that the contribution will reduce the taxpayer's refund or
4increase the amount of payment to accompany the return. Failure
5to remit any amount of increased payment shall reduce the
6contribution accordingly. Notwithstanding any other provision
7of law, moneys deposited into the Autism Care Fund from
8contributions under this Section shall be used by the
9Department of Human Services to make grants to the Autism
10Society of Illinois. This Section does not apply to any amended
11return.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.".
