2    AMENDMENT NO. ______. Amend Senate Bill 1891 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 4-221 as follows:
6    (605 ILCS 5/4-221)
7    Sec. 4-221. Mix designs.
8    (a) The Department shall develop and implement a
9performance-based specification applicable to designs for all
10hot mix asphalt projects, which includes minimum criteria for
11balancing acceptable safety and performance characteristics by
12using either testing methods approved by the American Society
13for Testing and Materials or standards approved by the American
14Association of State Highway and Transportation Officials.
15Within the parameters of the performance-based specification,
16it shall be the goal of the Department to incentivize the use

1of recycled materials, lower cost alternatives, and
2sustainable practices, including but not limited to, the use of
3recycled asphalt shingles, reclaimed asphalt pavement, warm
4mix asphalt, and ground tire rubber. In order to monitor the
5advancement of green technology initiatives, the Governor may
6appoint or designate 2 Department "sustainability officers";
7one officer responsible for the initiatives within District 1
8and the other officer responsible for the initiatives
9throughout the remainder of the State. Within 60 days after the
10completion of each fiscal year, the Department, either through
11its sustainability officers or on its own, shall provide a
12written report of the initiatives used in each district during
13the previous year. The report shall also include an analysis of
14the cost effectiveness of those initiatives and shall outline
15the proposed initiatives for the current year. A copy of the
16report shall be sent to the Speaker and Minority Leader of the
17House of Representatives and the President and Minority Leader
18of the Senate. The Department shall only be required to produce
19the report authorized under this subsection (a) for the first 3
20years after the effective date of this amendatory Act of the
2199th General Assembly.
22    (b) To the extent allowed by federal law, the Department
23specifications shall allow the use of recycled asphalt roofing
24shingles received from facilities authorized to process
25asphalt roofing shingles for recycling into asphalt pavement in
26accordance with (i) permits issued pursuant to Section 39 of

1the Environmental Protection Act or (ii) beneficial use
2determinations issued pursuant to Section 22.54 of the
3Environmental Protection Act. In creating the mix designs used
4for construction and maintenance of State highways, it shall be
5the goal of the Department, through its specifications, to
6maximize the percentage of recycled asphalt roofing shingles
7and binder replacement and to maximize the use of recycled
8aggregates and other lowest-cost constituents in the mix so
9long as there is no detrimental impact on life-cycle costs.
