AMENDMENT TO SENATE BILL 1891

2    AMENDMENT NO. ______. Amend Senate Bill 1891 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 4-221 as follows:
 
6    (605 ILCS 5/4-221)
7    Sec. 4-221. Mix designs.
8    (a) The Department shall develop and implement a
9performance-based specification applicable to designs for all
10hot mix asphalt projects, which includes minimum criteria for
11balancing acceptable safety and performance characteristics by
12using either testing methods approved by the American Society
13for Testing and Materials or full standards approved by the
14American Association of State Highway and Transportation
15Officials. Within the parameters of the performance-based
16specification, it shall be the goal of the Department to

1incentivize the use of recycled materials, lower cost
2alternatives, and sustainable practices, including but not
3limited to, the use of recycled asphalt shingles, reclaimed
4asphalt pavement, warm mix asphalt, and ground tire rubber. In
5order to monitor the advancement of green technology
6initiatives, the Governor may appoint or designate 2 Department
7"sustainability officers"; one officer responsible for the
8initiatives within District 1 and the other officer responsible
9for the initiatives throughout the remainder of the State.
10Within 60 days after the completion of each fiscal year, the
11Department, either through its sustainability officers or on
12its own, shall provide a written report of the initiatives used
13in each district during the previous year. The report shall
14also include an analysis of the cost effectiveness of those
15initiatives and shall outline the proposed initiatives for the
16current year. A copy of the report shall be sent to the Speaker
17and Minority Leader of the House of Representatives and the
18President and Minority Leader of the Senate.
19    (b) To the extent allowed by federal law, the Department
20specifications shall allow the use of recycled asphalt roofing
21shingles received from facilities authorized to process
22asphalt roofing shingles for recycling into asphalt pavement in
23accordance with (i) permits issued pursuant to Section 39 of
24the Environmental Protection Act or (ii) beneficial use
25determinations issued pursuant to Section 22.54 of the
26Environmental Protection Act. In creating the mix designs used

1for construction and maintenance of State highways, it shall be
2the goal of the Department, through its specifications, to
3maximize the percentage of recycled asphalt roofing shingles
4and binder replacement and to maximize the use of recycled
5aggregates and other lowest-cost constituents in the mix so
6long as there is no detrimental impact on life-cycle costs.
