AMENDMENT TO SENATE BILL 1846

2    AMENDMENT NO. ______. Amend Senate Bill 1846 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by changing Section
62605-485 as follows:
 
7    (20 ILCS 2605/2605-485)
8    Sec. 2605-485. Endangered Missing Person Advisory.
9    (a) A coordinated program known as the Endangered Missing
10Person Advisory is established within the Department of State
11Police. The purpose of the Endangered Missing Person Advisory
12is to provide a regional system for the rapid dissemination of
13information regarding a missing person who is believed to be a
14high-risk missing person as defined in Section 10 of the
15Missing Persons Identification Act.
16    (b) The AMBER Plan Task Force, established under Section

12605-480 of the Department of State Police Law, shall serve as
2the task force for the Endangered Missing Person Advisory. The
3AMBER Plan Task Force shall monitor and review the
4implementation and operation of the regional system developed
5under subsection (a), including procedures, budgetary
6requirements, and response protocols. The AMBER Plan Task Force
7shall also develop additional network resources for use in the
8system.
9    (c) The Department of State Police, in coordination with
10the Illinois Department on Aging, shall develop and implement a
11community outreach program to promote awareness among the
12State's healthcare facilities, nursing homes, assisted living
13facilities, and other senior centers. The guidelines and
14procedures shall ensure that specific health information about
15the missing person is not made public through the alert or
16otherwise.
17    (d) The Child Safety Coordinator, created under Section
182605-480 of the Department of State Police Law, shall act in
19the dual capacity of Child Safety Coordinator and Endangered
20Missing Person Coordinator. The Coordinator shall assist in the
21establishment of State standards and monitor the availability
22of federal funding that may become available to further the
23objectives of the Endangered Missing Person Advisory. The
24Department shall provide technical assistance for the
25Coordinator from its existing resources.
26    (e)(1) The Department of State Police, in cooperation with

1the Silver Search Task Force, shall develop as part of the
2Endangered Missing Person Advisory a coordinated statewide
3awareness program and toolkit to be used when a person 21 years
4of age or older who is believed to have Alzheimer's disease,
5other related dementia, or other dementia-like cognitive
6impairment is reported missing, which shall be referred to as
7Silver Search.
8    (2) The Department shall complete development and
9deployment of the Silver Search Awareness Program and toolkit
10on or before July 1, 2017.
11    (3) The Department of State Police shall establish a Silver
12Search Task Force within 90 days after the effective date of
13this amendatory Act of the 99th General Assembly to assist the
14Department in development and deployment of the Silver Search
15Awareness Program and toolkit. The Task Force shall establish
16the criteria and create a toolkit, which may include usage of
17Department of Transportation signs, under Section 2705-505.6
18of the Department of Transportation Law of the Civil
19Administrative Code of Illinois. The Task Force shall monitor
20and review the implementation and operation of that program,
21including procedures, budgetary requirements, standards, and
22minimum requirements for the training of law enforcement
23personnel on how to interact appropriately and effectively with
24individuals that suffer from Alzheimer's disease, other
25dementia, or other dementia-like cognitive impairment. The
26Task Force shall also develop additional network and financial

1resources for use in the system. The Task Force shall include,
2but is not limited to, one representative from each of the
3following:
4        (A) the Department of State Police;
5        (B) the Department on Aging;
6        (C) the Department of Public Health;
7        (D) the Illinois Law Enforcement Training Standards
8    Board;
9        (E) the Illinois Emergency Management Agency;
10        (F) the Secretary of State;
11        (G) the Department of Transportation;
12        (H) the Department of the Lottery;
13        (I) the Illinois Toll Highway Authority;
14        (J) the Alzheimer's Association;
15        (K) AARP of Illinois;
16        (L) Illinois Area Agencies on Aging;
17        (M) the Illinois Sheriffs' Association;
18        (N) the Illinois Association of Chiefs of Police;
19        (O) the Illinois Press Association;
20        (P) the Illinois Broadcasters Association;
21        (Q) a member of a large wireless telephone carrier; and
22        (R) a member of a small wireless telephone carrier.
23    The members of the Task Force designated in subparagraphs
24(A) through (I) of this paragraph (3) shall be appointed by the
25head of the respective agency. The members of the Task Force
26designated in subparagraphs (J) through (R) of this paragraph

1(3) shall be appointed by the Director of State Police. The
2Director of State Police or his or her designee shall serve as
3Chair of the Task Force.
4    The Task Force shall meet at least twice a year and shall
5provide a report on the operations of the Silver Search Program
6to the General Assembly and the Governor each year by June 30.
7    (4) Subject to appropriation, the Department of State
8Police, in coordination with the Department on Aging and the
9Silver Search Task Force, shall develop and implement a
10community outreach program to promote awareness of the Silver
11Search Program as part of the Endangered Missing Person
12Advisory among law enforcement agencies, the State's
13healthcare facilities, nursing homes, assisted living
14facilities, other senior centers, and the general population on
15or before January 1, 2017.
16    (5) The Child Safety Coordinator, created under Section
172605-480 of the Department of State Police Law of the Civil
18Administrative Code of Illinois, shall act in the capacity of
19Child Safety Coordinator, Endangered Missing Person
20Coordinator, and Silver Search Program Coordinator. The
21Coordinator, in conjunction with the members of the Task Force,
22shall assist the Department and the Silver Search Task Force,
23in the establishment of State standards and monitor the
24availability of federal and private funding that may become
25available to further the objectives of the Endangered Missing
26Person Advisory and Silver Search Awareness Program. The

1Department shall provide technical assistance for the
2Coordinator from its existing resources.

4    Section 10. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by adding
6Section 2705-505.6 as follows:
 
7    (20 ILCS 2705/2705-505.6 new)
8    Sec. 2705-505.6. Endangered Missing Persons Advisory
9message signs. The Department of Transportation shall
10coordinate with the Department of State Police in the use of
11electronic message signs on roads and highways to immediately
12provide critical information to the public concerning missing
13persons who are believed to be high risk, missing persons with
14Alzheimer's disease, other related dementia, or other
15dementia-like cognitive impairment, as allowed by federal
16guidelines.
 
17    Section 15. The Illinois Police Training Act is amended by
18changing Section 10.10 as follows:
 
19    (50 ILCS 705/10.10)
20    Sec. 10.10. Training in child abduction and missing
21endangered senior alert system.
22    (a) The Board shall conduct training programs for law

1enforcement personnel of local governmental agencies in the
2statewide coordinated child abduction alert system developed
3under Section 2605-480 of the Department of State Police Law of
4the Civil Administrative Code of Illinois and the statewide
5coordinated missing endangered senior alert system developed
6under Section 2605-375 of the Department of State Police Law of
7the Civil Administrative Code of Illinois.
8    (b) The Board shall conduct a training program for law
9enforcement personnel of local governmental agencies in the
10statewide Alzheimer's disease, other related dementia, or
11other dementia-like cognitive impairment coordinated Silver
12Search Awareness Program and toolkit developed under Section
132605-485 of the Department of State Police Law of the Civil
14Administrative Code of Illinois. The Board shall adopt written
15protocols and guidelines for the handling of missing persons
16cases involving Alzheimer's disease, other related dementia,
17or other dementia-like cognitive impairment based upon
18protocols developed by the Silver Search Task Force in
19conjunction with the Department of State Police on or before
20July 1, 2016.
