AMENDMENT TO SENATE BILL 1376

AMENDMENT NO. ______. Amend Senate Bill 1376 on page 3 by replacing lines 9 through 11 with the following:

"administrator, or special administrator."; and

on page 5 by replacing lines 15 through 17 with the following:

"person. Subject to Section 8(b), the court may grant a guardian the right to access:"; and

on page 9 by inserting immediately below line 8 the following:

"The custodian shall not charge for compliance with requests pursuant to this Section except to the extent the custodian regularly charges account holders themselves who make such requests."; and

on page 9, line 13, by deleting ", a small"; and

on page 9, line 14, by deleting "estate affidavit,"; and

on page 9, line 23, by deleting ", under penalty of perjury,"; and

on page 11, line 15, by replacing "certification" with "certification. A fiduciary who makes a certification under subsection (d) without knowledge that the representations contained in it are incorrect is not liable to any person for so acting".
