AMENDMENT TO SENATE BILL 543

2    AMENDMENT NO. ______. Amend Senate Bill 543, AS AMENDED,
3with reference to the page and line numbers of Senate Amendment
4No. 2, on page 2, by replacing lines 17 through 21 with the
5following:
 
6        "(6) CCB used as a functionally equivalent substitute
7    for agricultural lime as a soil conditioner.
8        (6.5) CCB that is a synthetic gypsum that:
9            (A) has a calcium sulfate dihydrate content
10        greater than 90%, by dry weight, and is generated by
11        the lime or limestone forced oxidation process;
12            (B) is registered with the Illinois Department of
13        Agriculture as a fertilizer or soil amendment and is
14        used as a fertilizer or soil amendment;
15            (C) is a functionally equivalent substitute for
16        mined gypsum (calcium sulfate dihydrate) used as a
17        fertilizer or soil amendment;

1            (D) is used in accordance with, and applied at a
2        rate consistent with, documented recommendations of a
3        qualified agricultural professional or institution,
4        including, but not limited to any of the following:
5        certified crop adviser, agronomist, university
6        researcher, federal Natural Resources Conservation
7        Service Conservation Practice Standard regarding the
8        amendment of soil properties with gypsum, or
9        State-approved nutrient management plan; but in no
10        case is applied at a rate greater than 5 dry tons per
11        acre per year; and
12            (E) has not been mixed with any waste."; and
 
13on page 7, immediately below line 5, by inserting the
14following:
 
15    "Section 99. Effective date. This Act takes effect upon
16becoming law.".
