AMENDMENT TO HOUSE JOINT RESOLUTION

CONSTITUTIONAL AMENDMENT 36

3    AMENDMENT NO. ___. Amend House Joint Resolution
4Constitutional Amendment 36 by replacing lines 3 through 23 on
5page 1 and all of pages 2 and 3 with the following:
6    "RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
7NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
8SENATE CONCURRING HEREIN, that there shall be submitted to the
9electors of the State for adoption or rejection at the general
10election next occurring at least 6 months after the adoption of
11this resolution a proposition to add Section 11 to Article IX
12of the Illinois Constitution as follows:

16SECTION 11. TRANSPORTATION FUNDS

1    (a) No moneys, including bond proceeds, derived from taxes,
2fees, excises, or license taxes relating to registration,
3title, or operation or use of vehicles, or related to the use
4of highways, roads, streets, bridges, mass transit, intercity
5passenger rail, ports, airports, or to fuels used for
6propelling vehicles, or derived from taxes, fees, excises, or
7license taxes relating to any other transportation
8infrastructure or transportation operation, shall be expended
9for purposes other than as provided in subsections (b) and (c).
10    (b) Transportation funds may be expended for the following:
11the costs of administering laws related to vehicles and
12transportation, including statutory refunds and adjustments
13provided in those laws; payment of highway obligations; costs
14for construction, reconstruction, maintenance, repair, and
15betterment of highways, roads, streets, bridges, mass transit,
16intercity passenger rail, ports, airports, or other forms of
17transportation; and other statutory highway purposes.
18Transportation funds may also be expended for the State or
19local share of highway funds to match federal aid highway
20funds, and expenses of grade separation of highways and
21railroad crossings, including protection of at-grade highways
22and railroad crossings, and, with respect to local governments,
23other transportation purposes as authorized by law.
24    (c) The costs of administering laws related to vehicles and
25transportation shall be limited to direct program expenses
26related to the following: the enforcement of traffic, railroad,

1and motor carrier laws; the safety of highways, roads, streets,
2bridges, mass transit, intercity passenger rail, ports, or
3airports; and the construction, reconstruction, improvement,
4repair, maintenance, operation, and administration of
5highways, under any related provisions of law or any purpose
6related or incident to, including grade separation of highways
7and railroad crossings. The limitations to the costs of
8administering laws related to vehicles and transportation
9under this subsection (c) shall also include direct program
10expenses related to workers' compensation claims for death or
11injury of employees of the State's transportation agency; the
12acquisition of land and the erection of buildings for highway
13purposes, including the acquisition of highway rights-of-way
14or for investigations to determine the reasonable anticipated
15future highway needs; and the making of surveys, plans,
16specifications, and estimates for the construction and
17maintenance of flight strips and highways. The expenses related
18to the construction and maintenance of flight strips and
19highways under this subsection (c) are for the purpose of
20providing access to military and naval reservations,
21defense-industries, defense-industry sites, and sources of raw
22materials, including the replacement of existing highways and
23highway connections shut off from general use at military and
24naval reservations, defense-industries, and defense-industry
25sites, or the purchase of rights-of-way.
26    (d) None of the revenues described in subsection (a) of

1this Section shall, by transfer, offset, or otherwise, be
2diverted to any purpose other than those described in
3subsections (b) and (c) of this Section.
4    (e) If the General Assembly appropriates funds for a mode
5of transportation not described in this Section, the General
6Assembly must provide for a dedicated source of funding.
7    (f) Federal funds may be spent for any purposes authorized
8by federal law.

SCHEDULE
10    This Constitutional Amendment takes effect upon being
11declared adopted in accordance with Section 7 of the Illinois
12Constitutional Amendment Act.".
