AMENDMENT TO HOUSE BILL 6226

AMENDMENT NO. ______. Amend House Bill 6226 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Highway Code is amended by adding Section 4-106 as follows:

(605 ILCS 5/4-106 new)

Sec. 4-106. Misrepresentation.

(a) In relation to the submission of plans, maps, specifications, costs of construction, bids, or contracts for any Department project, it is unlawful for the Department, its employees and its agents to knowingly falsify, distort, or misrepresent any facts concerning, but not limited to, the following:

(1) the character, quality, cost, or quantity of material already used or to be used;

(2) the quality or quantity of any work already performed or to be performed; and

(3) any other related costs.

(b) A violation of subsection (a) of this Section shall be punishable by a fine of not more than $10,000 or by imprisonment of not more than 5 years, or both. ".
