AMENDMENT TO HOUSE BILL 5783

2    AMENDMENT NO. ______. Amend House Bill 5783 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Illinois State Fairgrounds Foundation Act.
 
6    Section 5. Creation of Illinois State Fairgrounds
7Foundation.
8    (a) The General Assembly authorizes the Department of
9Agriculture, in accordance with Section 10 of the State Agency
10Entity Creation Act, to create the Illinois State Fairgrounds
11Foundation. Under this authority, the Department of
12Agriculture shall create the Illinois State Fairgrounds
13Foundation as a not-for-profit foundation. The Department
14shall file articles of incorporation as required under the
15General Not For Profit Corporation Act of 1986 to create the
16Foundation.

1    (b) The Foundation's Board of Directors shall be appointed
2as follows:
3        (1) 2 by the President of the Senate, 1 for a 2-year
4    term and 1 for a 4-year term;
5        (2) 2 by the Minority Leader of the Senate, 1 for a
6    2-year term and 1 for a 4-year term;
7        (3) 2 by the Speaker of the House of Representatives, 1
8    for a 2-year term and 1 for a 4-year term;
9        (4) 2 by the Minority Leader of the House of
10    Representatives, 1 for a 2-year term and 1 for a 4-year
11    term; and
12        (5) 4 by the Governor, 2 for a 2-year term each and 2
13    for a 4-year term each.
14    (c) At the expiration of the 2-year terms and the 4-year
15terms, each successive appointment shall be for a 4-year term.
16Vacancies shall be filled by the official who made the prior
17appointment. The Director of Agriculture shall chair the Board
18of Directors of the Foundation. No member of the Board of
19Directors may receive compensation for his or her services to
20the Foundation.
 
21    Section 10. Foundation purposes. The purposes of the
22Foundation are: to promote, support, assist, sustain, and
23encourage the charitable, educational, scientific, and
24agricultural programs, projects, and policies of the
25Department of Agriculture and the Illinois State Fair; to

1solicit and accept aid or contributions consistent with the
2stated intent of the donor and the goals of the Foundation,
3including, but not limited to, capital funding for the
4improvement, maintenance, or construction of buildings and
5facilities at the Illinois State Fairgrounds located in
6Springfield and DuQuoin; to accept grants for the acquisition,
7construction, improvement, and development of potential
8Foundation projects; to solicit and generate private funding
9and donations that assist in enhancing and preserving Illinois'
10agricultural heritage and State Fairgrounds, both in
11Springfield and DuQuoin, and the infrastructure, including
12roads, buildings, permanent exhibits, grounds, and facilities
13at both Fairgrounds; and to engage generally in other lawful
14endeavors consistent with the foregoing purposes. The
15Foundation shall operate within the provisions of the General
16Not For Profit Corporation Act of 1986.
 
17    Section 15. Organization, powers, and duties of the
18Foundation.
19    (a) As soon as practical after the Foundation is created,
20the Board of Directors shall meet, organize, and designate, by
21majority vote, a treasurer, secretary, and any additional
22officers that may be needed to carry out the activities of the
23Foundation, and shall adopt bylaws of the Foundation. The
24Department of Agriculture may adopt other rules deemed
25necessary to govern Foundation procedures.

1    (b) The Foundation may accept gifts or grants from the
2federal government, its agencies or officers, or from any
3person, firm, or corporation, and may expend receipts on
4activities that it considers suitable to the performance of its
5duties under this Act and consistent with any requirement of
6the grant, gift, or bequest. Funds collected by the Foundation
7shall be considered private funds, except those received from
8public entities, and shall be held in an appropriate account
9outside of the State Treasury. Private funds collected by the
10Foundation are not subject to the Public Funds Investment Act.
11The treasurer of the Foundation shall be custodian of all
12Foundation funds. The Foundation's accounts and books shall be
13set up and maintained in a manner approved by the Auditor
14General; and the Foundation and its officers shall be
15responsible for the approval of recording of receipts, approval
16of payments, and the proper filing of required reports. The
17Foundation may be assisted in carrying out its functions by
18personnel of the Department of Agriculture. The Department
19shall provide reasonable assistance to the Foundation to
20achieve the purposes of the Foundation. The Foundation shall
21cooperate fully with the boards, commissions, agencies,
22departments, and institutions of the State. The funds held and
23made available by the Illinois State Fairgrounds Foundation
24shall be subject to financial and compliance audits by the
25Auditor General in compliance with the Illinois State Auditing
26Act.

1    (c) The Foundation shall not have any power of eminent
2domain.
3    (d) The Foundation shall be considered a public body under
4the Prevailing Wage Act. Any project, including but not limited
5to improvement, maintenance, and construction of
6infrastructure, that is funded in whole or in part by the
7Foundation shall be considered a public work as defined by the
8Prevailing Wage Act.
 
9    Section 20. Disclosure to donors of exemption from Public
10Funds Investment Act. The Foundation must provide a written
11notice to any entity providing a gift, grant, or bequest to the
12Foundation that the Foundation is not subject to the provisions
13of the Public Funds Investment Act which places limitations on
14the types of securities in which a public agency may invest
15public funds.
 
16    Section 105. The Department of Natural Resources Act is
17amended by changing Sections 20-5 and 20-15 as follows:

19    Sec. 20-5. State Museum. The State shall operate an
20Illinois State Museum in Springfield and at branch sites at
21Dickson Mounds, Lockport, Rend Lake, and the James R. Thompson
22Center. The Illinois State Museum and all branch sites shall be
23open to the public. The Illinois State Museum shall operate a

1research and collections center to research, preserve, and
2maintain access to the extensive Illinois State Museum
3collections. The Department of Natural Resources shall have
4within it the office of the Illinois State Museum. The Board of
5the Illinois State Museum is retained as the advisory governing
6board for the State Museum.

9    Sec. 20-15. Entrance fee.
10    The Department may set, by the Director, by administrative
11rule an entrance fee for visitors to the Illinois State Museum.
12A different fee may be charged for different classes of
13visitors. The fee assessed by this Section shall be deposited
14into the Illinois State Museum Fund for the Department to use
15to support the Illinois State Museum. The monies deposited into
16the Illinois State Museum Fund under this Section shall not be
17subject to administrative charges or chargebacks unless
18otherwise authorized by this Act.

20    Section 110. The Employment and Economic Opportunity for
21Persons with Disabilities Task Force Act is amended by changing
22Section 10 as follows:

1    Sec. 10. Employment and Economic Opportunity for Persons
2with Disabilities Task Force.
3    (a) The Employment and Economic Opportunity for Persons
4with Disabilities Task Force is created.
5    (b) The Employment and Economic Opportunity for Persons
6with Disabilities Task Force shall be appointed and hold its
7first meeting within 90 days after the effective date of this
8Act, be convened by the Governor, and operate with
9administrative support from the Illinois Department of Human
10Services Employment Security.
11    (c) The Task Force shall be comprised of the following
12representatives of State Government: a high-ranking member of
13the Governor's management team, designated by the Governor;
14representatives of each division of the Department of Human
15Services, designated by the Secretary of Human Services; the
16Director of Healthcare and Family Services, or his or her
17designee; the Director of Veterans' Affairs or his or her
18designee; the Director of Commerce and Economic Opportunity or
19his or her designee; the Director of Employment Security or his
20or her designee; the Executive Director of the Illinois Council
21on Developmental Disabilities or his or her designee; and the
22State Superintendent of Education or his or her designee.
23    (d) The Task Force shall also consist of no more than 15
24public members who shall be appointed by the Governor and who
25represent the following constituencies: statewide
26organizations that advocate for persons with physical,

1developmental and psychiatric disabilities, entities with
2expertise in assistive technology devices and services for
3persons with disabilities, advocates for veterans with
4disabilities, centers for independent living, disability
5services providers, organized labor, higher education, the
6private sector business community, entities that provide
7employment and training services to persons with disabilities,
8and at least 5 persons who have a disability.
9    (e) The Task Force shall be co-chaired by the
10representative of the Governor and a public member who shall be
11chosen by the other public members of the Task Force.
12    (f) The Task Force members shall serve voluntarily and
13without compensation. Persons with disabilities serving on the
14Task Force shall be accommodated to enable them to fully
15participate in Task Force activities.
16    (g) The co-chairs of the Task Force shall extend an
17invitation to chairs and minority spokespersons of appropriate
18legislative committees to attend all meetings of the Task
19Force, and may invite other individuals who are not members of
20the Task Force to participate in subcommittees of the Task
21Force or to take part in discussions of topics for which those
22individuals have particular expertise.
23    (h) The Task Force shall coordinate its work with existing
24State advisory bodies whose work may include employment and
25economic opportunity for persons with disabilities.

1    Section 999. Effective date. This Act takes effect upon
2becoming law.".
