| 2 | | AMENDMENT NO. ______. Amend House Bill 5649 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Illinois Vehicle Code is amended by | 5 | | changing Section 3-634 as follows:
| 6 | | (625 ILCS 5/3-634)
| 7 | | Sec. 3-634. Illinois Fire Fighters' License Plate.
| 8 | | (a) The Secretary, upon receipt of an application made in | 9 | | the form
prescribed by the Secretary of State, may issue | 10 | | special registration plates
designated to be Illinois Fire | 11 | | Fighters' Memorial license plates. The special
plates issued | 12 | | under
this Section shall be affixed only to passenger vehicles | 13 | | of the first division, motorcycles having an engine over 150cc,
| 14 | | motor vehicles of the second
division weighing not more than | 15 | | 8,000 pounds, or
recreational vehicles as defined in Section | 16 | | 1-169 of this Code,
and subject to the
staggered registration |

| 1 | | system. Plates issued under this Section shall
expire according | 2 | | to the multi-year
procedure established by Section 3-414.1 of | 3 | | this Code.
| 4 | | (b) The design and color of the plates shall be wholly | 5 | | within the discretion
of the Secretary of State. The Secretary | 6 | | of State may, in his or her
discretion, allow the plates to be | 7 | | issued as vanity plates or personalized in
accordance with | 8 | | Section 3-405.1 of this Code. The plates are not required to
| 9 | | designate "Land of Lincoln", as prescribed in subsection (b) of | 10 | | Section 3-412
of this Code. The Secretary of State shall | 11 | | prescribe stickers or decals as
provided under Section 3-412.
| 12 | | (c) An applicant shall be charged a $27 fee for original | 13 | | issuance in
addition to the applicable registration fee. Of
| 14 | | this additional fee, $15 shall be deposited into the Secretary | 15 | | of State
Special License Plate Fund and $12 shall be
deposited | 16 | | into the Illinois Fire Fighters' Memorial Fund.
For each | 17 | | registration renewal period, a $17 fee, in addition to the
| 18 | | appropriate registration fee, shall be charged.
Of this fee, $2 | 19 | | shall be deposited into the Secretary of State Special License
| 20 | | Plate Fund and $15 shall be deposited into
the Illinois Fire | 21 | | Fighters' Memorial Fund.
| 22 | | (d) In addition to the purpose specified in Section | 23 | | 2-119(n), moneys in
the Illinois Fire Fighters' Memorial Fund | 24 | | shall, except as otherwise provided in subsection (e) and | 25 | | subject to appropriation by
the General Assembly and | 26 | | distribution by the Secretary, be used exclusively for the |

| 1 | | following purposes: | 2 | | (1) maintaining
the Illinois Fire Fighters' Memorial;
| 3 | | (2) holding an annual memorial
commemoration and Medal | 4 | | of Honor ceremony and related activities; and | 5 | | (3) providing scholarships, for graduate study, | 6 | | undergraduate study, or both, to children and spouses of | 7 | | fire fighters
killed in the line of duty. | 8 | | (e) No more than 10% of the annual proceeds of the Illinois | 9 | | Fire Fighters' Memorial Fund may, subject to appropriation by | 10 | | the General Assembly and distribution by the Secretary, be used | 11 | | for exhibits for and the maintenance of the Illinois Fire | 12 | | Fighter Museum, except that the 10% limit may be exceeded to | 13 | | pay for emergency repairs related to the structural stability | 14 | | of the Illinois Fire Fighter Museum. Prior to exceeding the 10% | 15 | | limit, the Office of the State Fire Marshal shall obtain the | 16 | | approval of a majority of the members of the Illinois Fire | 17 | | Fighters Memorial Foundation.
