1 AMENDMENT TO HOUSE BILL 4477
2     AMENDMENT NO. ______. Amend House Bill 4477, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:

5     "Section 5. The Illinois Procurement Code is amended by
6 adding Section 30-50 as follows:

7     (30 ILCS 500/30-50 new)
8     Sec. 30-50. Mobilization payments.
9     (a) As used in this Section, "mobilization payment" means
10 an advance payment to a contractor or subcontractor that
11 enables the contractor or subcontractor to purchase necessary
12 machinery and tools for a project. "Mobilization payment" may
13 also include other goods or services necessary for a project
14 when expressly provided for within the contract.
15     (b) All contracts under this Code entered into by the
16 Department of Transportation shall provide for mobilization

1 payments unless explicitly rejected by the contractor.
2     (c) When a contract under this Code entered into by the
3 Department of Transportation provides for mobilization
4 payments and the contractor is using the services of a
5 subcontractor, the subcontract shall include terms requiring
6 mobilization payments be made to the subcontractor.
7     Mobilization payments to a subcontractor shall be made on a
8 tiered system based on the total value of the subcontract:
9 Subcontract value Mobilization percentage
10 Less than $10,000 25%
11 $10,000-$19,999 20%
12 $20,000-$39,999 18%
13 $40,000-$59,999 16%
14 $60,000-$79,999 14%
15 $80,000-$99,999 12%
16 $100,000-$249,999 10%
17 $250,000-$499,999 9%
18 $500,000-$750,000 8%
19 Over $750,000 7%
20     (d) This Section only applies to contracts entered into by
21 the Department of Transportation.".
