    Amends the Transportation Network Providers Act. Provides that if the Governor has, by proclamation, declared that a disaster exists, a transportation network company shall not employ surge pricing in the areas subject to the disaster for the duration of the proclamation. Defines "surge pricing".

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Transportation Network Providers Act is
5amended by changing Sections 5 and 30 as follows:

9    Sec. 5. Definitions.
10    "Surge pricing" means charging passengers a higher fare
11rate than the regular fare rate displayed on the transportation
12network company's website or in its software application
13service by utilizing a rate multiplier during times of high
14demand.
15    "Transportation network company" or "TNC" means an entity
16operating in this State that uses a digital network or software
17application service to connect passengers to transportation
18network company services provided by transportation network
19company drivers. A TNC is not deemed to own, control, operate,
20or manage the vehicles used by TNC drivers, and is not a
21taxicab association or a for-hire vehicle owner.
22    "Transportation network company driver" or "TNC driver"
23means an individual who operates a motor vehicle that is:

1        (1) owned, leased, or otherwise authorized for use by
2    the individual;
3        (2) not a taxicab or for-hire public passenger vehicle;
4    and
5        (3) used to provide transportation network company
6    services.
7    "Transportation network company services" or "TNC
8services" means transportation of a passenger between points
9chosen by the passenger and prearranged with a TNC driver
10through the use of a TNC digital network or software
11application. TNC services shall begin when a TNC driver accepts
12a request for transportation received through the TNC's digital
13network or software application service, continue while the TNC
14driver transports the passenger in the TNC driver's vehicle,
15and end when the passenger exits the TNC driver's vehicle. TNC
16service is not a taxicab, for-hire vehicle, or street hail
17service.

22    Sec. 30. Operational.
23    (a) A TNC may charge a fare for the services provided to
24passengers; provided that, if a fare is charged, the TNC shall
25disclose to passengers the fare calculation method on its

1website or within the software application service.
2    (a-5) If the Governor has, by proclamation, declared that a
3disaster exists under Section 7 of the Illinois Emergency
4Management Agency Act, a TNC shall not employ surge pricing in
5the areas subject to the disaster for the duration of the
6proclamation.
7    (b) The TNC shall provide passengers with the applicable
8rates being charged and the option to receive an estimated fare
9before the passenger enters the TNC driver's vehicle.
10    (c) The TNC's software application or website shall display
11a picture of the TNC driver, and the license plate number of
12the motor vehicle utilized for providing the TNC service before
13the passenger enters the TNC driver's vehicle.
14    (d) Within a reasonable period of time following the
15completion of a trip, a TNC shall transmit an electronic
16receipt to the passenger that lists:
17        (1) the origin and destination of the trip;
18        (2) the total time and distance of the trip; and
19        (3) an itemization of the total fare paid, if any.
20    (e) Dispatches for TNC services shall be made only to
21eligible TNC drivers under Section 15 of this Act who are
22properly licensed under State law and local ordinances
23addressing these drivers if applicable.
24    (f) A taxicab may accept a request for transportation
25received through a TNC's digital network or software
26application service, and may charge a fare for those services

1that is similar to those charged by a TNC.
