SYNOPSIS AS INTRODUCED:
 
210 ILCS 85/6.09b new

    Amends the Hospital Licensing Act. Provides that within 24 hours after a patient's placement into observation status by a hospital, the hospital shall provide that patient with an oral and written notice that the patient is not admitted to the hospital and is under observation status. Provides that the written notice shall be signed by the patient or the patient's legal representative to acknowledge receipt of the notice. Requires the notice to contain certain information. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Hospital Licensing Act is amended by adding
5Section 6.09b as follows:
 
6    (210 ILCS 85/6.09b new)
7    Sec. 6.09b. Patient notice of observation status. Within
824 hours after a patient's placement into observation status by
9a hospital, the hospital shall provide that patient with an
10oral and written notice that the patient is not admitted to the
11hospital and is under observation status. The written notice
12shall be signed by the patient or the patient's legal
13representative to acknowledge receipt of the written notice and
14shall include, but not be limited to, the following
15information:
16        (1) a statement that observation status may affect
17    coverage under the federal Medicare program, the medical
18    assistance program under Article V of the Illinois Public
19    Aid Code, or the patient's insurance policy for the current
20    hospital services, including medications and other
21    pharmaceutical supplies, as well as coverage for any
22    subsequent discharge to a skilled nursing facility or for
23    home and community based care; and

1        (2) a statement that the patient should contact his or
2    her insurance provider to better understand the
3    implications of being placed into observation status.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
