AMENDMENT TO HOUSE BILL 3588

2    AMENDMENT NO. ______. Amend House Bill 3588, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Department of State Police Law of the Civil
6Administrative Code of Illinois is amended by adding Section
72605-605 as follows:
 
8    (20 ILCS 2605/2605-605 new)
9    Sec. 2605-605. Law enforcement field testing to instantly
10identify synthetic drugs.
11    (a) The Department of State Police shall create a pilot
12program that uses technologies and protocols to instantly
13identify synthetic cannabinoids and cathinones (synthetic
14drugs), as well as other designer drugs. The pilot program
15shall focus on using technology capable of presumptive
16identification of illicit drugs in the field.

1    (b) A minimum of 3 separate districts in the State shall be
2equipped to operate the pilot program. The Department of State
3Police may choose to have one or more of the pilot sites
4located within a municipal or county police department.
5    (c) Before July 30, 2016, the Department of State Police
6shall submit a report to the General Assembly outlining the
7findings of the pilot program, and make any recommendation on
8whether the technologies and protocols selected for the pilot
9program can be used to help prevent the growth of synthetic
10drugs and other illicit drugs throughout the State. The
11evaluation shall include, but is not limited to, the following:
12        (1) review of technical capabilities and accuracy
13    rates of technologies and protocols selected for the pilot
14    program;
15        (2) the impact on State and local crime laboratory
16    backlogs if the technologies and protocols selected could
17    eliminate the need to send synthetic drugs, or other
18    illicit drugs to the crime laboratory for presumptive
19    testing, including the potential cost savings to State and
20    local government; and
21        (3) the status of court acceptance of the technologies
22    and protocols selected for the pilot program for the
23    presumptive identification of synthetic drugs and other
24    illicit drugs.
 
25    Section 99. Effective date. This Act takes effect upon
