AMENDMENT TO HOUSE BILL 3485

2    AMENDMENT NO. ______. Amend House Bill 3485 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Fair
5Practices in Contracting Task Force Act.
 
6    Section 5. Purpose and members.
7    (a) There is created the Fair Practices in Contracting Task
8Force to:
9        (1) thoroughly survey African-American-owned business
10    participation in State procurement;
11        (2) study African-American-owned subcontractors'
12    ability to be paid in a timely manner and the communication
13    processes between subcontractors and prime contractors and
14    the State;
15        (3) research solutions and methods to address the
16    disparity in procurement awards; and

1        (4) produce a final report summarizing the Task Force's
2    findings and detailing recommended statutory or
3    constitutional strategies to recognize best practices.
4    (b) The Task Force shall consist of the following members:
5        (1) Two members appointed by the Speaker of the House
6    of Representatives, one of whom must be a member of the
7    House of Representative, and one whom must be from the
8    Department of Central Management Services, the Department
9    of Transportation, or the Department of Health and Family
10    Services;
11        (2) Two members appointed by the Minority Leader of the
12    House of Representatives, one of whom must be a member of
13    the House of Representative, and one whom must be from the
14    Department of Central Management Services, the Department
15    of Transportation, or the Department of Health and Family
16    Services;
17        (3) Two members appointed by the President of the
18    Senate, one of whom must be a member of the Senate, and one
19    whom must be from the Department of Central Management
20    Services, the Department of Transportation, or the
21    Department of Health and Family Services;
22        (4) Two members appointed by the Minority Leader of the
23    Senate, one of whom must be a member of the Senate, and one
24    whom must be from the Department of Central Management
25    Services, the Department of Transportation, or the
26    Department of Health and Family Services; and

1        (5) Four members appointed by the Governor, all of whom
2    must be from the Department of Central Management Services,
3    the Department of Transportation, or the Department of
4    Health and Family Services.
5    (c) Members shall serve without compensation.
 
6    Section 10. Meetings.
7    (a) The Task Force shall hold its first meeting by March 1,
82016.
9    (b) The Department of Central Management Services shall
10assist the Task Force and provide administrative support, but
11shall have no hand in guiding its direction or ascertaining its
12results.
13    (c) The Task Force shall meet quarterly and report its
14findings to the General Assembly and the appropriate
15committees.
16    (d) The Task Force shall submit its final report to the
17General Assembly and the Governor no later than December 31,
182017.
 
19    Section 15. Repeal date. This Act is repealed on January
202, 2019.".
