1    AN ACT concerning finance.
 
2    WHEREAS, African-Americans represent 14.7% of the total
3population of Illinois residents; the unemployment rate for
4African-Americans in Illinois is projected to be 13.5%, nearly
5double the rate for the total State population; and
 
6    WHEREAS, African-Americans represent 9.5% of the ownership
7of total Illinois businesses; the total value of State
8contracts awarded to African-American-owned businesses in 2013
9was less than 1% of total Central Management Services spending;
10and
 
11    WHEREAS, Unemployment leads to a decline in communities,
12resulting in foreclosures, abandoned buildings, violence,
13depression, and poverty; therefore
 
14    Be it enacted by the People of the State of Illinois,
15represented in the General Assembly:
 
16    Section 1. Short title. This Act may be cited as the Fair
17Practices in Contracting Task Force Act.
 
18    Section 5. Purpose and members.
19    (a) There is created the Fair Practices in Contracting Task
20Force to:

1        (1) thoroughly survey African-American-owned business
2    participation in State procurement;
3        (2) study African-American-owned subcontractors'
4    ability to be paid in a timely manner and the communication
5    processes between subcontractors and prime contractors and
6    the State;
7        (3) research solutions and methods to address the
8    disparity in procurement awards; and
9        (4) produce a final report summarizing the Task Force's
10    findings and detailing recommended statutory or
11    constitutional strategies to recognize best practices.
12    (b) The Task Force shall consist of the following members:
13        (1) Two members appointed by the Speaker of the House
14    of Representatives, one of whom must be a member of the
15    House of Representatives, and one whom must be from the
16    Department of Central Management Services, the Department
17    of Transportation, or the Department of Health and Family
18    Services;
19        (2) Two members appointed by the Minority Leader of the
20    House of Representatives, one of whom must be a member of
21    the House of Representatives, and one whom must be from the
22    Department of Central Management Services, the Department
23    of Transportation, or the Department of Health and Family
24    Services;
25        (3) Two members appointed by the President of the
26    Senate, one of whom must be a member of the Senate, and one

1    whom must be from the Department of Central Management
2    Services, the Department of Transportation, or the
3    Department of Health and Family Services;
4        (4) Two members appointed by the Minority Leader of the
5    Senate, one of whom must be a member of the Senate, and one
6    whom must be from the Department of Central Management
7    Services, the Department of Transportation, or the
8    Department of Health and Family Services; and
9        (5) Four members appointed by the Governor, all of whom
10    must be from the Department of Central Management Services,
11    the Department of Transportation, or the Department of
12    Health and Family Services.
13    (c) Members shall serve without compensation.
 
14    Section 10. Meetings.
15    (a) The Task Force shall hold its first meeting by March 1,
162016.
17    (b) The Department of Central Management Services shall
18assist the Task Force and provide administrative support, but
19shall have no hand in guiding its direction or ascertaining its
20results.
21    (c) The Task Force shall meet quarterly and report its
22findings to the General Assembly and the appropriate
23committees.
24    (d) The Task Force shall submit its final report to the
25General Assembly and the Governor no later than December 31,

2    Section 15. Repeal date. This Act is repealed on January
32, 2019.
