AMENDMENT TO HOUSE BILL 3323

2    AMENDMENT NO. ______. Amend House Bill 3323, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Environmental Protection Act is amended by
6adding Section 14.7 as follows:
 
7    (415 ILCS 5/14.7 new)
8    Sec. 14.7. Preservation of community water supplies.
9    (a) The Agency shall adopt rules governing certain
10corrosion prevention projects carried out on community water
11supplies. Those rules shall not apply to buried pipelines
12including, but not limited to, pipes, mains, and joints. The
13rules shall exclude routine maintenance activities of
14community water supplies including, but not limited to, the use
15of protective coatings applied by the owner's utility personnel
16during the course of performing routine maintenance

1activities. The activities may include, but not be limited to,
2the painting of fire hydrants; routine over-coat painting of
3interior and exterior building surfaces such as floors, doors,
4windows, and ceilings; and routine touch-up and over-coat
5application of paint products typically found on water utility
6pumps, pipes, tanks, and other water treatment plant
7appurtenances and utility owned structures. Those rules shall
8include:
9        (1) standards for ensuring that community water
10    supplies carry out corrosion prevention and mitigation
11    methods according to corrosion prevention industry
12    standards adopted by the Agency;
13        (2) requirements that community water supplies use:
14            (A) protective coatings personnel to carry out
15        corrosion prevention and mitigation methods on any
16        type of substrate or surface, including, but not
17        limited to, concrete and steel tanks; water treatment
18        pipe galleys; doors; walls; ceilings; grating;
19        interior and exterior cabinets related to controls,
20        pumps, and generators; or any other water treatment
21        appurtenances where protective coatings are utilized
22        for corrosion control and prevention to prolong the
23        life of the water utility asset; and
24            (B) inspectors to ensure that best practices and
25        standards are adhered to on each corrosion prevention
26        project; and

1        (3) standards to prevent environmental degradation
2    that might occur as a result of carrying out corrosion
3    prevention and mitigation methods including, but not
4    limited to, standards to prevent the improper handling and
5    containment of hazardous materials, especially lead paint,
6    removed from the exterior of a community water supply.
7    In adopting rules under this subsection (a), the Agency
8shall obtain input from corrosion industry experts
9specializing in the training of personnel to carry out
10corrosion prevention and mitigation methods.
11    (b) As used in this Section:
12    "Community water supply" has the meaning ascribed to that
13term in Section 3.145 of this Act.
14    "Corrosion" means a naturally occurring phenomenon
15commonly defined as the deterioration of a material (usually a
16metal) that results from a chemical or electrochemical reaction
17with its environment.
18    "Corrosion prevention and mitigation methods" means:
19        (1) the preparation, application, installation,
20    removal, or general maintenance as necessary of a
21    protective coating system, including any or more of the
22    following:
23            (A) surface preparation and coating application on
24        the exterior or interior of a community water supply;
25            (B) removal of a lead-based or other hazardous
26        coating from a community water supply;

1            (C) shop painting of structural steel fabricated
2        for installation as part of a community water supply;
3        or
4            (D) installation of any polymer coating or
5        surfacing on any concrete, or other cementitious
6        substrate, that is a part of a community water supply;
7        and
8        (2) any other activities that are (i) related to
9    corrosion prevention, such as cathodic protection, of a
10    community water supply and (ii) determined by the Agency to
11    require industry trained personnel to carry out.
12    "Corrosion prevention project" means carrying out
13corrosion prevention and mitigation methods.
14    (c) This Section shall apply to only those projects
15receiving 100% funding from the State.
16    (d) Any contractors providing services covered by this
17Section shall comply with Section 30-22 of the Illinois
18Procurement Code. The requirements of this Section do not apply
19to an individual licensed under the Professional Engineering
20Practice Act of 1989 or the Structural Engineering Act of 1989.
 
21    Section 10. The Illinois Highway Code is amended by adding
22Section 4-106 as follows:
 
23    (605 ILCS 5/4-106 new)
24    Sec. 4-106. Preservation of bridge infrastructure.

1    (a) The Department may adopt rules governing all corrosion
2prevention projects carried out on eligible bridges. Rules may
3include a process for ensuring that corrosion prevention and
4mitigation methods are carried out according to corrosion
5prevention industry standards adopted by the Department for
6eligible bridges that include:
7        (1) a plan to prevent environmental degradation that
8    could occur as a result of carrying out corrosion
9    prevention and mitigation methods including the careful
10    handling and containment of hazardous materials,
11    especially lead paint; and
12        (2) consulting and interacting directly with, for the
13    purpose of utilizing industry trained personnel, corrosion
14    industry experts specializing in the design and inspection
15    of corrosion prevention and mitigation methods on bridges
16    containing lead-based or other hazardous coatings.
17    (b) As used in this Section:
18    "Corrosion" means a naturally occurring phenomenon
19commonly defined as the deterioration of a material(usually a
20metal) that results from a chemical or electrochemical reaction
21with its environment.
22    "Corrosion prevention and mitigation methods" means:
23        (1) the preparation, application, installation,
24    removal, or general maintenance as necessary of a
25    protective coating system including the following:
26            (A) surface preparation and coating application on

1        an eligible bridge;
2            (B) removal of a lead-based or other hazardous
3        coating from an eligible bridge; or
4            (C) shop painting of structural steel fabricated
5        for installation as part of an eligible bridge; and
6        (2) any other activities related to corrosion
7    prevention, such as cathodic protection, on eligible
8    bridges determined by the Department that require industry
9    trained personnel to carry out.
10    "Corrosion prevention project" means carrying out
11corrosion prevention and mitigation methods during
12construction, alteration, maintenance, repair work, or at any
13other time necessary on an eligible bridge.
14    "Eligible bridge" means a bridge or overpass the
15construction, alteration, maintenance, or repair work on which
16is 100% funded by the State.
17    (c) The requirements of this Section do not apply to an
18individual licensed under the Professional Engineering
19Practice Act of 1989 or the Structural Engineering Act of 1989.
 
20    Section 99. Effective date. This Act takes effect July 1,
212016.".
