2    AMENDMENT NO. ______. Amend House Bill 2487 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Illinois Seed Law is amended by changing
5Section 7 and adding Section 2.132a as follows:
6    (505 ILCS 110/2.132a new)
7    Sec. 2.132a. Seed library. "Seed library" means a
8nonprofessional nonprofit, cooperative, or governmental
9organization that is registered on a website of a state-wide
10conservation organization and holds, donates, and receives
11donations of open-pollinated seeds to and from the public for
12non-commercial and educational uses for the purpose of
13encouraging horticulture-based education, non-commercial
14gardening, biodiversity, and the preservation of
15open-pollinated plant varieties.

1    (505 ILCS 110/7)  (from Ch. 5, par. 407)
2    Sec. 7. Exemptions. The provisions of Sections 4 through
34.5 and Sections 5 and 5.1 do not apply:
4    (1) To seed or grain not intended for sowing purposes.
5    (2) To seed in storage in, or being transported or
6consigned to a cleaning or conditioning establishment for
7cleaning or conditioning, provided, that the invoice or
8labeling accompanying any shipment of said seed bears the
9statement "seed for conditioning"; and provided that any
10labeling or other representation which may be made with respect
11to the uncleaned or unconditioned seed shall be subject to this
13    (3) To any carrier in respect to any seed transported or
14delivered for transportation in the ordinary course of its
15business as a carrier; provided, that such carrier is not
16engaged in producing, processing, or marketing agricultural,
17vegetable or other seeds designated by the Department of
18Agriculture subject to the provisions of this Act.
19    (4) To seed in an Illinois seed library that is as free
20from noxious and exotic weeds as possible.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
