505 ILCS 110/13.5 new

Amends the Illinois Seed Law. Provides that seed libraries shall be exempt from all licensing, testing, labeling, and other requirements of the Act. Effective immediately.

A BILL FOR

AN ACT concerning agriculture.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Seed Law is amended by adding Sections 2.132a and 13.5 as follows:

(505 ILCS 110/2.132a new)

Sec. 2.132a. Seed library. "Seed library" means a nonprofit, cooperative, or governmental organization that holds, donates, and receives donations of open-pollinated seeds to and from the public for non-commercial and educational uses for the purpose of encouraging horticulture-based education, non-commercial gardening, biodiversity, and the preservation of open-pollinated plant varieties.

Sec. 13.5. Seed library exemption. Notwithstanding any other provision of this Act, seed libraries shall be exempt from all licensing, testing, labeling, and other requirements of this Act.

Section 99. Effective date. This Act takes effect upon becoming law.
