SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-170 new
225 ILCS 50/18.3 new

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that health care workers licensed by the State be automatically and indefinitely suspended at such time as the final trial proceedings are concluded whereby a licensee has been adjudicated and found guilty, or has entered a plea of guilty or nolo contendere, in a criminal prosecution under the laws of the State, the laws of any other state, or the laws of the United States of America for any offense reasonably related to the qualifications, functions, or duties of their profession, or arising out of any investigation thereof, and for any offense in which defrauding Medicare, Medicaid, or any other health insurance provider is an essential element, whether or not sentence is imposed. Makes conforming changes in the Hearing Instrument Consumer Protection Act.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 2105-170 as follows:
 
7    (20 ILCS 2105/2105-170 new)
8    Sec. 2105-170. Health care workers; automatic suspension
9of license. A health care worker, as defined by the Health Care
10Worker Self-Referral Act, licensed by the Department shall be
11automatically and indefinitely suspended at such time as the
12final trial proceedings are concluded whereby a licensee has
13been adjudicated and found guilty, or has entered a plea of
14guilty or nolo contendere, in a criminal prosecution under the
15laws of the State, the laws of any other state, or the laws of
16the United States of America for any offense reasonably related
17to the qualifications, functions, or duties of their
18profession, or arising out of any investigation thereof, and
19for any offense in which defrauding Medicare, Medicaid, or any
20other health insurance provider is an essential element,
21whether or not sentence is imposed.
 
22    Section 10. The Hearing Instrument Consumer Protection Act

1is amended by adding Section 18.3 as follows:
 
2    (225 ILCS 50/18.3 new)
3    Sec. 18.3. Automatic suspension of license. A hearing
4instrument dispenser licensed under this Act shall be
5automatically and indefinitely suspended at such time as the
6final trial proceedings are concluded whereby a licensee has
7been adjudicated and found guilty, or has entered a plea of
8guilty or nolo contendere, in a criminal prosecution under the
9laws of the State, the laws of any other state, or the laws of
10the United States of America for any offense reasonably related
11to the qualifications, functions, or duties of their
12profession, or arising out of any investigation thereof, and
13for any offense in which defrauding Medicare, Medicaid, or any
14other health insurance provider is an essential element,
15whether or not sentence is imposed.
