AMENDMENT TO HOUSE BILL 245

2    AMENDMENT NO. ______. Amend House Bill 245, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. If and only if House Bill 229 of the 99th
6General Assembly becomes law, then the Counties Code is amended
7by changing Section 5-44020 and adding Section 5-44060 as
8follows:
 
9    (55 ILCS 5/5-44020)
10    Sec. 5-44020. Definitions. In this Division 5-44:
11    "Fire protection jurisdiction" means a fire protection
12district, municipal fire department, or service organized
13under Section 5-1056.1 of the Counties Code, Sections 195 and
14200 of the Township Code, Section 10-2.1 of the Illinois
15Municipal Code, or the Illinois Fire Protection District Act.
16    "Governing board" means the individual or individuals who

1constitute the corporate authorities of a unit of local
2government.
3    "Unit of local government" or "unit" means any unit of
4local government located entirely within one county, to which
5the county board chairman or county executive directly appoints
6a majority of its governing board with the advice and consent
7of the county board, but shall not include a fire protection
8district that directly employs any regular full-time
9employees, a conservation district organized under the
10Conservation District Act, or a special district organized
11under the Water Commission Act of 1985.

13    (55 ILCS 5/5-44060 new)
14    Sec. 5-44060. Rights of former employees. On the effective
15date of dissolution, the employees of the former unit of local
16government shall be transferred to the governmental unit
17assuming the functions of the former unit of local government.
18The status and rights of employees represented by an exclusive
19bargaining representative shall not be affected by the
20consolidation or this amendatory Act of the 99th General
21Assembly. Obligations assumed by the government unit assuming
22the functions of the former governmental unit shall include the
23obligation to honor existing representation rights under the
24Illinois Public Labor Relations Act and any existing collective
25bargaining agreements. The rights of employees under any

1existing pension, retirement, or annuity plan shall not be
2affected by the consolidation or this amendatory Act of the
399th General Assembly.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
