2    AMENDMENT NO. ______. Amend House Bill 217 on page 9, by
3replacing lines 1 through 20 with the following:
4    "Section 25. Advertisement and sales; misrepresentation.
5No person or entity may, in the conduct of any trade or
6commerce, use or employ any deception, fraud, false pretense,
7false promise, misrepresentation, or the concealment,
8suppression, or omission of any material fact in advertising or
9otherwise offering conversion therapy services in a manner that
10represents homosexuality as a mental disease, disorder, or
11illness, with intent that others rely upon the concealment,
12suppression, or omission of such material fact. A violation of
13this Section constitutes an unlawful practice under the
14Consumer Fraud and Deceptive Business Practices Act.
15    Section 30. Discipline. Any sexual orientation change
16efforts attempted on a person under the age of 18 by a mental

1health provider may be considered unprofessional conduct.
2Mental health providers found to have engaged in a sexual
3orientation change effort on a patient under the age of 18 may
4be subject to discipline by the licensing entity or
5disciplinary review board with competent jurisdiction.
6    Section 90. The Consumer Fraud and Deceptive Business
7Practices Act is amended by changing Section 2Z as follows:
8    (815 ILCS 505/2Z)  (from Ch. 121 1/2, par. 262Z)
9    Sec. 2Z. Violations of other Acts. Any person who knowingly
10violates the Automotive Repair Act, the Automotive Collision
11Repair Act, the Home Repair and Remodeling Act, the Dance
12Studio Act, the Physical Fitness Services Act, the Hearing
13Instrument Consumer Protection Act, the Illinois Union Label
14Act, the Job Referral and Job Listing Services Consumer
15Protection Act, the Travel Promotion Consumer Protection Act,
16the Credit Services Organizations Act, the Automatic Telephone
17Dialers Act, the Pay-Per-Call Services Consumer Protection
18Act, the Telephone Solicitations Act, the Illinois Funeral or
19Burial Funds Act, the Cemetery Oversight Act, the Cemetery Care
20Act, the Safe and Hygienic Bed Act, the Pre-Need Cemetery Sales
21Act, the High Risk Home Loan Act, the Payday Loan Reform Act,
22the Mortgage Rescue Fraud Act, subsection (a) or (b) of Section
233-10 of the Cigarette Tax Act, subsection (a) or (b) of Section
243-10 of the Cigarette Use Tax Act, the Electronic Mail Act, the

1Internet Caller Identification Act, paragraph (6) of
2subsection (k) of Section 6-305 of the Illinois Vehicle Code,
3Section 11-1431, 18d-115, 18d-120, 18d-125, 18d-135, 18d-150,
4or 18d-153 of the Illinois Vehicle Code, Article 3 of the
5Residential Real Property Disclosure Act, the Automatic
6Contract Renewal Act, Section 25 of the Youth Mental Health
7Protection Act, or the Personal Information Protection Act
8commits an unlawful practice within the meaning of this Act.
