SYNOPSIS AS INTRODUCED:
 
ILCON Art. V, Sec. 2
ILCON Art. V, Sec. 7

    Proposes to amend the Executive Article of the Illinois Constitution. Provides that for a vacancy in an elective office other than Governor or Lieutenant Governor: if there are 28 or fewer months remaining in the term, the appointee shall hold office until the end of the term; and if there are more than 28 months remaining in the term, the appointee shall hold office until a successor is elected to serve the remainder of the term at the next general election. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5SENATE CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to Sections 2 and 7 of Article V
9of the Illinois Constitution as follows:

THE EXECUTIVE

12    (ILCON Art. V, Sec. 2)
13SECTION 2. TERMS
14    These elected officers of the Executive Branch shall hold
15office for four years beginning on the second Monday of January
16after their election and, except in the case of the Lieutenant
17Governor, until their successors are qualified. Except as
18provided in Section 7, they They shall be elected at the
19general election in 1978 and every four years thereafter.

22SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES

1    If the Attorney General, Secretary of State, Comptroller or
2Treasurer fails to qualify or if his office becomes vacant, the
3Governor shall fill the office by appointment. If there are 28
4or fewer months remaining in the term, the appointee shall hold
5office until the end of the term. If there are more than 28
6months remaining in the term, the The appointee shall hold
7office until the elected officer qualifies or until a successor
8is elected at the next general election and qualified as may be
9provided by law and shall not be subject to removal by the
10Governor. If the Lieutenant Governor fails to qualify or if his
11office becomes vacant, it shall remain vacant until the end of
12the term.

SCHEDULE
15    This Constitutional Amendment takes effect upon being
16declared adopted in accordance with Section 7 of the Illinois
17Constitutional Amendment Act.
