AMENDMENT TO SENATE BILL 3265

AMENDMENT NO. ______. Amend Senate Bill 3265 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Municipal Code is amended by adding Section 11-80-24 as follows:

Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing system may operate a docking station in any area in any municipality if (1) the area is adjacent to the primary entrance of any elementary or secondary school building, (2) the area is within 125 feet of any entrance to any elementary or secondary school building, and (3) the area may be used as a fire lane by emergency vehicles.

For purposes of this Section:

"Bicycle sharing system" means a fleet of bicycles that are locked into a network of docking stations that may be rented from and returned to any station in the system.

"Docking station" includes, but is not limited to, a touch-screen kiosk, station map, and a docking system that releases bicycles using a member key or code.

"Fire lane" shall have the same meaning provided under subsection (h) of Section 11-209 of the Illinois Vehicle Code.

A home rule municipality may not regulate bicycle sharing systems in a manner less restrictive than requirements of this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.".
