AMENDMENT TO SENATE BILL 206

2    AMENDMENT NO. ______. Amend Senate Bill 206 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Secretary of State Merit Employment Code is
5amended by changing Section 12 as follows:
 
6    (15 ILCS 310/12)  (from Ch. 124, par. 112)
7    Sec. 12.
8    (a) Except as provided in subsection (b), employees
9Employees of the Office of the Secretary of State - election to
10public office - leave of absence - re-entry of service. Any
11person holding a position in the Office of the Secretary of
12State, who is elected to public office, shall, upon request, be
13granted a leave of absence, without pay, from such position.
14The leave of absence shall continue so long as he or she
15remains an elected officer or for a period of 5 years,
16whichever is shorter. and for a period of 30 calendar days

1thereafter.
2    If such person files a written request with the Director of
3Personnel to re-enter active service with the Office of the
4Secretary of State within the such 30 day period following the
5termination of his or her leave of absence he or she may shall
6be reinstated to his or her former position or a position of
7comparable duties, responsibilities, and pay. The Office of the
8Secretary of State shall, by mail, notify an employee on leave
9of absence under this Section on the effective date of this
10amendatory Act of the 98th General Assembly of the leave of
11absence change.
12    (b) Employees on leave of absence under this Section on the
13effective date of this amendatory Act of the 98th General
14Assembly are subject to the following conditions:
15        (1) An employee whose leave of absence has not exceeded
16    5 years shall be subject to the requirements of subsection
17    (a) of this Section.
18        (2) An employee whose leave of absence has exceeded 5
19    years shall not be barred from re-entering active service
20    by the 5 year limit under subsection (a) of this Section if
21    the employee files a written request to re-enter active
22    service as required under subsection (a) of this Section
23    within 30 days of the date that the Secretary of State
24    mailed the notice to the employee as required under
25    subsection (a) of this Section. The Secretary of State may
26    reinstate the employee as provided in subsection (a) of
