AMENDMENT TO SENATE BILL 202

2    AMENDMENT NO. ______. Amend Senate Bill 202 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Southern Illinois University Management
5Act is amended by changing Sections 2, 4, and 5 as follows:
 
6    (110 ILCS 520/2)  (from Ch. 144, par. 652)
7    Sec. 2. On the effective date of this amendatory Act of the
898th General Assembly, the terms of office of the members of
9the Board serving on that effective date shall terminate and
10the Board shall be reconstituted. After the effective date of
11this amendatory Act of the 98th General Assembly, the The Board
12shall consist of 7 members appointed by the Governor, by and
13with the advice and consent of the Senate, as follows: at least
143 appointees shall hold an undergraduate or graduate degree
15from the Southern Illinois University at Edwardsville campus or
16have their principal residence within 60 miles of the Southern

1Illinois University at Edwardsville campus and at least 3
2appointees shall hold an undergraduate or graduate degree from
3the Southern Illinois University at Carbondale campus or have
4their principal residence within 60 miles of the Southern
5Illinois University at Carbondale campus. The Governor may
6consider other factors, including without limitation if an
7immediate family member of the appointee has attended or
8currently attends Southern Illinois University or any other
9factor that may establish a substantial connection between the
10appointee and Southern Illinois University. The Board shall
11also consist of the State Superintendent of Education Public
12Instruction, or his or her chief assistant for liaison with
13higher education when designated to serve in his or her place,
14ex-officio, and 2 one voting student members. member designated
15by the Governor from one campus of the University and one
16nonvoting student member from the campus of the University not
17represented by the voting student member. The Governor shall
18designate one of the student members serving on the Board to
19serve as the voting student member. Each student member shall
20be selected chosen by the respective campuses of Southern
21Illinois University at Carbondale and Edwardsville. The method
22of selecting choosing these student members shall be by
23campus-wide student election, and any student designated by the
24Governor to be a voting student member shall be one of the
25students chosen by this method. The student members shall serve
26terms of one year beginning on July 1 of each year, except that

1the student members initially selected shall serve a term
2beginning on the date of such selection and expiring on the
3next succeeding June 30. To be eligible for selection as a
4student member and to be eligible to remain as a voting or
5nonvoting student member of the Board, a student member must be
6a resident of this State, must have and maintain a grade point
7average that is equivalent to at least 2.5 on a 4.0 scale, and
8must be a full time student enrolled at all times during his or
9her term of office except for that part of the term which
10follows the completion of the last full regular semester of an
11academic year and precedes the first full regular semester of
12the succeeding academic year at the university (sometimes
13commonly referred to as the summer session or summer school).
14If a voting or nonvoting student member serving on the Board
15fails to continue to meet or maintain the residency, minimum
16grade point average, or enrollment requirement established by
17this Section, his or her membership on the Board shall be
18deemed to have terminated by operation of law. No more than 4
19of the members appointed by the Governor shall be affiliated
20with the same political party. Each member appointed by the
21Governor must be a resident of this State. A failure to meet or
22maintain this residency requirement constitutes a resignation
23from and creates a vacancy in the Board. The terms of the
24members appointed by the Governor, by and with the advice and
25consent of the Senate, pursuant to this amendatory Act of the
2698th General Assembly shall expire as follows: the terms of one

1member each from the Southern Illinois University at
2Edwardsville campus and the Southern Illinois University at
3Carbondale campus shall expire on the third Monday in January
42015; the terms of one member each from the Southern Illinois
5University at Edwardsville campus and the Southern Illinois
6University at Carbondale campus shall expire on the third
7Monday in January 2017; and the terms of the remaining 3
8members shall expire on the third Monday in January 2019. Upon
9the expiration of the terms of members appointed by the
10Governor, their respective successors shall be appointed for
11terms of 6 years from the third Monday in January of each
12odd-numbered year and until their respective successors are
13appointed for like terms. If the Senate is not in session
14appointments shall be made as in the case of vacancies.

18    Sec. 4. Members of the Board shall serve without
19compensation but shall be entitled to reasonable amounts for
20expenses necessarily incurred in the performance of their
21duties. Such expenses incurred by any non-voting student member
22may, at the discretion of the Chairman of the Board, be
23provided for by advance payment to such member, who shall
24account therefor to the Board immediately after each meeting.
25    No member of the Board shall hold or be employed in or

1appointed to any office or place under the authority of the
2Board, nor shall any member of the Board be directly or
3indirectly interested in any contract made by the Board, nor
4shall he be an employee of the State Government. This section
5does not prohibit the student members of the Board from
6maintaining normal and official status as enrolled students or
7normal student employment at Southern Illinois University.

10    Sec. 5. Members of the Board shall elect annually by secret
11ballot from their own number a chairman, who shall preside over
12meetings of the Board, and a secretary. The chairman shall be
13elected to serve for a one-year term, and no member may serve
14consecutive one-year terms as chairman.
15    Meetings of the Board shall be held at least once each
16quarter on a campus of Southern Illinois University. At all
17regular meetings of the Board, a majority of its voting members
18shall constitute a quorum. The student members shall have all
19of the privileges of membership, including the right to make
20and second motions and to attend executive sessions and , other
21than the right to vote, except that the student member
22designated by the Governor as the voting student member shall
23have the right to vote on all Board matters except those
24involving faculty tenure, faculty promotion, or any issue on
25which the student member has a direct conflict of interest. A

1student member who is not entitled to vote on a measure at a
2meeting of the Board or any of its committees shall not be
3considered a member for the purpose of determining whether a
4quorum is present at the time that measure is voted upon. No
5action of the Board shall be invalidated by reason of any
6vacancies on the Board, or by reason of any failure to select a
7student member.
8    Special meetings of the Board may be called by the chairman
9of the Board or by any 3 members of the Board.
10    At each regular and special meeting that is open to the
11public, members of the public and employees of the University
12shall be afforded time, subject to reasonable constraints, to
13make comments to or ask questions of the Board.

16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
