SYNOPSIS AS INTRODUCED:
 
605 ILCS 10/9.5

    Amends the Toll Highway Act. Provides that if there is a conflict between state and federal law or regulations regarding the Illinois State Toll Highway Authority's ability to pay relocation costs to persons displaced by the Authority's exercise of eminent domain powers, the Authority shall use whichever law or regulation provides the highest payment limit. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Toll Highway Act is amended by changing
5Section 9.5 as follows:
 
6    (605 ILCS 10/9.5)
7    Sec. 9.5. Acquisition by purchase or by condemnation. The
8Authority is authorized to acquire by purchase or by
9condemnation, in the manner provided for the exercise of the
10power of eminent domain under the Eminent Domain Act, any and
11all lands, buildings, and grounds necessary or convenient for
12its authorized purpose. The Authority shall comply with the
13federal Uniform Relocation Assistance and Real Property
14Acquisition Policies Act, Public Law 91-646, as amended, and
15the implementing regulations in 49 CFR Part 24 and is
16authorized to operate a relocation program and to pay
17relocation costs. If there is a conflict between the provisions
18of this amendatory Act of 1998 and the provisions of the
19federal law or regulations, however, the provisions of this
20amendatory Act of 1998 shall control with the exception that
21the Authority shall use whichever law or regulation provides
22the highest payment limit. The Authority is authorized to
23exceed the maximum payment limits of the federal Uniform

1Relocation Assistance and Real Property Acquisition Policies
2Act when necessary to ensure the provision of decent, safe, or
3sanitary housing, or to secure a suitable relocation site. The
4Authority may not adopt rules to implement the federal law or
5regulations referenced in this Section unless those rules have
6received the prior approval of the Joint Committee on
7Administrative Rules.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
