AMENDMENT TO HOUSE BILL 3836

2    AMENDMENT NO. ______. Amend House Bill 3836 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Abraham Lincoln Presidential Library and Museum Act.
 
6    Section 5. Definitions. For the purposes of this Act:
7    "Agency" means the Abraham Lincoln Presidential Library
8and Museum.
9    "Board" means the Board of the Abraham Lincoln Presidential
10Library and Museum.
11    "Executive Director" means the Executive Director of the
12Abraham Lincoln Presidential Library and Museum.
13    "Library" means the Abraham Lincoln Presidential Library.
14    "Museum" means the Abraham Lincoln Presidential Museum.

1Museum; establishment; Foundation.
2    (a) The Abraham Lincoln Presidential Library and Museum,
3formerly a constituent unit of the Illinois Historic
4Preservation Agency, is created as an independent State agency.
5    (b) The Agency shall be under the supervision and direction
6of the Executive Director of the Abraham Lincoln Presidential
7Library and Museum.
8    (c) There shall be a Board of the Abraham Lincoln
9Presidential Library and Museum to advise the Abraham Lincoln
10Presidential Library and Museum and the Executive Director on
11programs related to the Abraham Lincoln Presidential Library
12and Museum. The Abraham Lincoln Presidential Library and Museum
13and the Abraham Lincoln Presidential Library Foundation shall
14mutually co-operate to maximize resources available to the
15Abraham Lincoln Presidential Library and Museum and to support,
16sustain, and provide educational programs and collections at
17the Abraham Lincoln Presidential Library and Museum.
 
18    Section 15. Board; initial members.
19    (a) The Board of the Abraham Lincoln Presidential Library
20and Museum shall consist of 11 members to be appointed by the
21Governor, with the advice and consent of the Senate. Each of
22these members shall have recognized knowledge and ability in
23matters relating to history, research, cultural institutions,
24archives, libraries, business, or education. The terms of
25office of these members shall be 6 years, except that the terms

1of office of the initial members shall commence from the
2effective date of this Act and run as provided under subsection
3(b) of this Section.
4    (b) The appointees that currently serve, as of the
5effective date of this Act, on the Advisory Board of the
6Lincoln Presidential Library and Museum previously created
7under Section 30 of the Historic Preservation Agency Act (now
8repealed) shall serve as the initial members of the Board
9created under Section 10 of this Act until they complete the
10unexpired portions of the terms to which they were appointed
11under Section 31 of the Historic Preservation Agency Act (now
12repealed) or until the Governor appoints a successor to replace
13the initial member. Successors, including a new Chairperson,
14shall be appointed by the Governor in accordance with
15subsection (a) of this Section.
 
16    Section 20. Powers and duties of the Board. The Board shall
17have the following powers and duties:
18    (a) Establish programs for implementation in support of the
19mission and goals of the Abraham Lincoln Presidential Library
20and Museum.
21    (b) Create and execute such seminars, symposia, or other
22conferences as may be necessary or advisable to the Abraham
23Lincoln Presidential Library and Museum.
24    (c) Report annually to the Governor and the General
25Assembly on the status of the Abraham Lincoln Presidential

1Library and Museum and its programs.
2    (d) Hire agents and employees necessary to carry out the
3duties and purposes of the Abraham Lincoln Presidential Library
4and Museum.
5    (e) Accept, hold, maintain, and administer, as trustee,
6property given in trust for educational or historic purposes
7for the benefit of the people of the State of Illinois and to
8dispose of any property under the terms of the instrument
9creating the trust.
10    (f) Accept, hold, maintain, and administer donated
11property of historical significance such as books, papers,
12records, and personal property of any kind, including
13electronic and digital property, pursuant to gifting
14instruments, agreements, or deeds of gift and to enter into
15such agreements as may be necessary to carry out the Board's
16duties and responsibilities under this Section.
17    (g) Lease concessions at the Library and Museum. All
18leases, for whatever period, shall be made subject to the
19written approval of the Governor. All concession leases
20extending for a period in excess of 10 years shall contain
21provisions for the Abraham Lincoln Presidential Library and
22Museum to participate, on a percentage basis, in the revenues
23generated by any concession operation.
24    (h) Enforce the laws of the State and the rules of the
25Abraham Lincoln Presidential Library and Museum at the Library
26and Museum.

1    (i) Cooperate with private organizations and agencies of
2the State of Illinois by providing areas and the use of staff
3personnel where feasible for the sale of publications on the
4historic and cultural heritage of the State and craft items
5made by Illinois craftsmen. These sales shall not conflict with
6existing concession agreements. The Board is authorized to
7negotiate and approve agreements with the organizations and
8agencies for a portion of the monies received from sales to be
9returned to the Abraham Lincoln Presidential Library and Museum
10for the furtherance of interpretive and restoration programs.
11    (j) Establish local bank or savings and loan association
12accounts, upon the written authorization of the Executive
13Director, to temporarily hold income received at any of its
14properties. The local accounts established under this
15subsection shall be in the name of the Abraham Lincoln
16Presidential Library and Museum and shall be subject to regular
17audits. The balance in a local bank or savings and loan
18association account shall be forwarded to the Abraham Lincoln
19Presidential Library and Museum for deposit with the State
20Treasurer on Monday of each week if the amount to be deposited
21in a fund exceeds $500.
22    No bank or savings and loan association shall receive
23public funds as permitted by this Section, unless it has
24complied with the requirements established under Section 6 of
25the Public Funds Investment Act.
26    (k) Accept offers of gifts, gratuities, or grants from the

1federal government, its agencies, or offices, or from any
2person, firm, or corporation.
3    (l) Subject to the provisions of the Illinois
4Administrative Procedure Act, make reasonable rules as may be
5necessary to discharge the duties of the Abraham Lincoln
6Presidential Library and Museum.
7    (m) Charge and collect admission fees and rental for access
8to and use of the facilities of the Library and Museum.
9    (n) Operate a restaurant, café, or other food serving
10facility at the Museum or to lease the operation of such a
11facility under reasonable terms and conditions; to provide
12vending services for food, beverages, or other products deemed
13necessary and proper, consistent with the mission and purposes
14of the Library and Museum.
15    (o) To engage in marketing activities designed to promote
16the Library and Museum. In undertaking these activities, the
17Board may take all necessary steps with respect to products and
18services, including, but not limited to, retail sales,
19wholesale sales, direct marketing, mail order sales, telephone
20sales, advertising and promotion, purchase of product and
21materials inventory, design, printing and manufacturing of new
22products, reproductions, and adaptations, copyright and
23trademark licensing and royalty agreements, and payment of
24applicable taxes. In addition, the Board shall have the
25authority to sell advertising in its publications and printed
26materials.

1    Section 25. Administration of the Abraham Lincoln
2Presidential Library and Museum. The Board shall appoint an
3Executive Director of the Abraham Lincoln Presidential Library
4and Museum. The Executive Director shall serve at the pleasure
5of the Board. The Executive Director shall, subject to
6applicable provisions of law, execute and discharge the powers
7and duties of the Abraham Lincoln Presidential Library and
8Museum. The Executive Director shall appoint: (a) a Library
9Facilities Operations Director; and (b) a Director of the
10Library. The Executive Director shall appoint those other
11employees of the Abraham Lincoln Presidential Library and
12Museum and the Illinois State Historical Library as he or she
13deems appropriate and shall fix the compensation of the Library
14Facilities Operations Director, the Director of the Library,
15and other employees. The Executive Director may establish and
16collect admission and registration fees, may operate a gift
17shop, and may publish and sell educational and informational
18materials.
 
19    Section 30. Gifts to the Illinois State Historical Library.
20Those programs, collections, and functions heretofore
21administered by the Illinois State Historical Library or the
22Historical Preservation Agency's Historical Library Division
23shall be administered by the Abraham Lincoln Presidential
24Library and Museum. All gifts made specifically to the Illinois

1State Historical Library or the Historical Preservation
2Agency's Historical Library Division shall remain at all times
3within the Abraham Lincoln Presidential Library and Museum.
 
4    Section 35. Director of the Abraham Lincoln Presidential
5Library; historical collections. The Director of the Library
6may and is hereby required to make all necessary rules,
7regulations, and bylaws not inconsistent with law to carry into
8effect the purposes of this Section in accordance with the
9State Historical Library Act and to procure from time to time
10as may be possible and practicable, at reasonable cost, all
11books, pamphlets, manuscripts, monographs, writings, and other
12material of historical interest and useful to the historian
13bearing upon the political, physical, religious, or social
14history of the State of Illinois from the earliest known period
15of time. The Director of the Library may exchange any books,
16pamphlets, manuscripts, records, or other material which such
17library may acquire that are of no historical interest or for
18any reason are of no value to it, with any other library,
19school, or historical society. The Director of the Library
20shall distribute volumes of the series known as the Illinois
21Historical Collections now in print, and to be printed, to all
22who may apply for same and who pay to the Library for such
23volumes an amount fixed by the Director sufficient to cover the
24expenses of printing and distribution of each volume received
25by such applicants. However, the Director of the Library shall

1have authority to furnish not to exceed 25 of each of the
2volumes of the Illinois Historical Collections, free of charge
3to each of the authors and editors of the collections or parts
4thereof; to furnish, as in his or her discretion he or she
5deems necessary or desirable, a reasonable number of each of
6the volumes of the Collections without charge to archives,
7libraries, and similar institutions from which material has
8been drawn or assistance has been given in the preparation of
9such Collections, and to the officials thereof; to furnish, as
10in his or her discretion he or she deems necessary or
11desirable, a reasonable number of each of the volumes of the
12Collections without charge to the University of Illinois
13Library and to instructors and officials of that University,
14and to public libraries in the State of Illinois. The Director
15of the Library may also make exchanges of Historical
16Collections with any other library, school, or historical
17society, and to distribute volumes of collections for review
18purposes.
 
19    Section 40. Separation from Historic Preservation Agency.
20On the effective date of this Act, all of the powers, duties,
21assets, liabilities, employees, contracts, property, including
22any items formerly contained in the Illinois State Historical
23Library now presently held in the Abraham Lincoln Presidential
24Library and Museum, records, pending business, and unexpended
25appropriations of the Historic Preservation Agency related to

1the administration and enforcement of Sections 17, 30, 31, 32,
2and 33 of the Historic Preservation Agency Act (now repealed)
3are transferred to the Abraham Lincoln Presidential Library and
4Museum created under this Act.
5    The status and rights of the transferred employees, and the
6rights of the State of Illinois and its agencies, under the
7Personnel Code and applicable collective bargaining agreements
8or under any pension, retirement, or annuity plan are not
9affected (except as provided in Sections 14-110 and 18-127 of
10the Illinois Pension Code) by that transfer or by any other
11provision of this Act.
 
12    Section 45. The Executive Reorganization Implementation
13Act is amended by changing Section 3.1 as follows:
 
14    (15 ILCS 15/3.1)  (from Ch. 127, par. 1803.1)
15    Sec. 3.1. "Agency directly responsible to the Governor" or
16"agency" means any office, officer, division, or part thereof,
17and any other office, nonelective officer, department,
18division, bureau, board, or commission in the executive branch
19of State government, except that it does not apply to any
20agency whose primary function is service to the General
21Assembly or the Judicial Branch of State government, or to any
22agency administered by the Attorney General, Secretary of
23State, State Comptroller or State Treasurer. In addition the
24term does not apply to the following agencies created by law

1with the primary responsibility of exercising regulatory or
2adjudicatory functions independently of the Governor:
3    (1) the State Board of Elections;
4    (2) the State Board of Education;
5    (3) the Illinois Commerce Commission;
6    (4) the Illinois Workers' Compensation Commission;
7    (5) the Civil Service Commission;
8    (6) the Fair Employment Practices Commission;
9    (7) the Pollution Control Board;
10    (8) the Department of State Police Merit Board;
11    (9) the Illinois Racing Board;
12    (10) the Illinois Power Agency; .
13    (11) the Abraham Lincoln Presidential Library and Museum.

15    Section 50. The Historic Preservation Agency Act is amended
16by changing Sections 2, 4, 5, 5.1, 6, 11, 12, 13, 14, 15, 16,
1722, and 34 as follows:

20    (a) "Agency" means the Historic Preservation Agency;
21    (b) "Board" means the Board of Trustees of the Historic
22Preservation Agency;

6Lincoln Presidential Library; and
7    (g) (Blank). "Historic Sites and Preservation Division"
8means that part of the Agency that is headed by the Director of
9Historic Sites and Preservation.

12    Sec. 4. The Board shall be responsible for setting and
13determining policy for the Agency. The Agency shall consist of:
14(1) an Abraham Lincoln Presidential Library and Museum and (2)
15a Historic Sites and Preservation Division. Except as otherwise
16provided in this Act, any reference in any other Act to the
17Historic Preservation Agency shall be deemed to be a reference
18to the Historic Sites and Preservation Division and any
19reference to the Director of Historic Preservation shall be
20deemed to be a reference to the Director of Historic Sites and
21Preservation, unless the context clearly indicates otherwise.
22    The Board shall appoint a chief executive officer of the
23Agency who shall be known as the Director of the Historic Sites
24and Preservation Agency. The Director shall serve at the
25pleasure of the Board. The Director shall, subject to

1applicable provisions of law, execute the powers and discharge
2the duties vested in the Historic Sites and Preservation
3Division of the Agency by law and implement the policies set by
4the Board. The Director shall manage the Historic Sites and
5Preservation Division of the Agency. The Director, with the
6concurrence of the Board, shall appoint Division Chiefs, if
7needed, and the Deputy Director of the Historic Sites and
8Preservation Division of the Agency. Subject to concurrence by
9the Board, the Director shall appoint such other employees of
10the Historic Sites and Preservation Division of the Agency as
11he or she deems appropriate and shall fix the compensation of
12such Division Chiefs, if any, the Deputy Director, and other
13employees. The Board shall appoint the Illinois State
14Historian, who shall provide historical expertise, support,
15and service to all divisions of the Historic Preservation
16Agency and to all divisions of the Agency, if any. The State
17Historian is the State's authority on Abraham Lincoln and the
18history of Illinois.

4in the Department of Conservation by "An Act relating to the
5planning, acquisition and development of outdoor recreation
6resources and facilities, and authorizing the participation by
7the State of Illinois its political subdivisions and qualified
8participants in programs of Federal assistance relating
9thereto", approved July 6, 1965, as amended, solely as it
10relates to the powers, rights, duties and obligations
11heretofore exercised by the Department of Conservation over

6    Sec. 16. The Historic Sites and Preservation Division of
7the Agency shall have the following additional powers:
8    (a) To hire agents and employees necessary to carry out the
9duties and purposes of the Historic Sites and Preservation
10Division of the Agency.
11    (b) To take all measures necessary to erect, maintain,
12preserve, restore, and conserve all State Historic Sites and
13State Memorials, except when supervision and maintenance is
14otherwise provided by law. This authorization includes the
15power, with the consent of the Board, to enter into contracts,
16acquire and dispose of real and personal property, and enter
17into leases of real and personal property. The Agency has the
18power to acquire, for purposes authorized by law, any real
19property in fee simple subject to a life estate in the seller
20in not more than 3 acres of the real property acquired, subject
21to the restrictions that the life estate shall be used for
22residential purposes only and that it shall be
23non-transferable.
24    (c) To provide recreational facilities including camp

1recreational facilities at all sites under the jurisdiction of
2the Agency.
3    (d) To lay out, construct and maintain all needful roads,
4parking areas, paths or trails, bridges, camp or lodge sites,
5picnic areas, lodges and cabins, and any other structures and
6improvements necessary and appropriate in any State historic
7site or easement thereto; and to provide water supplies, heat
8and light, and sanitary facilities for the public and living
9quarters for the custodians and keepers of State historic
10sites.
11    (e) To grant licenses and rights-of-way within the areas
12controlled by the Historic Sites and Preservation Division of
13the Agency for the construction, operation and maintenance
14upon, under or across the property, of facilities for water,
15sewage, telephone, telegraph, electric, gas, or other public
16service, subject to the terms and conditions as may be
17determined by the Agency.
18    (f) To authorize the officers, employees and agents of the
19Historic Sites and Preservation Division of the Agency, for the
20purposes of investigation and to exercise the rights, powers,
21and duties vested and that may be vested in it, to enter and
22cross all lands and waters in this State, doing no damage to
23private property.
24    (g) To transfer jurisdiction of or exchange any realty
25under the control of the Historic Sites and Preservation
26Division of the Agency to any other Department of the State

1Government, or to any agency of the Federal Government, or to
2acquire or accept Federal lands, when any transfer, exchange,
3acquisition or acceptance is advantageous to the State and is
4approved in writing by the Governor.
5    (h) To erect, supervise, and maintain all public monuments
6and memorials erected by the State, except when the supervision
7and maintenance of public monuments and memorials is otherwise
8provided by law.
9    (i) To accept, hold, maintain, and administer, as trustee,
10property given in trust for educational or historic purposes
11for the benefit of the People of the State of Illinois and to
12dispose, with the consent of the Board, of any property under
13the terms of the instrument creating the trust.
14    (j) To lease concessions on any property under the
15jurisdiction of the Agency for a period not exceeding 25 years
16and to lease a concession complex at Lincoln's New Salem State
17Historic Site for which a cash incentive has been authorized
18under Section 5.1 of the Historic Preservation Agency Act for a
19period not to exceed 40 years. All leases, for whatever period,
20shall be made subject to the written approval of the Governor.
21All concession leases extending for a period in excess of 10
22years, will contain provisions for the Agency to participate,
23on a percentage basis, in the revenues generated by any
24concession operation.
25    The Agency is authorized to allow for provisions for a
26reserve account and a leasehold account within Agency

1concession lease agreements for the purpose of setting aside
2revenues for the maintenance, rehabilitation, repair,
3improvement, and replacement of the concession facility,
4structure, and equipment of the Agency that are part of the
5leased premises.
6    The lessee shall be required to pay into the reserve
7account a percentage of gross receipts, as set forth in the
8lease, to be set aside and expended in a manner acceptable to
9the Agency by the concession lessee for the purpose of ensuring
10that an appropriate amount of the lessee's moneys are provided
11by the lessee to satisfy the lessee's incurred responsibilities
12for the operation of the concession facility under the terms
13and conditions of the concession lease.
14    The lessee account shall allow for the amortization of
15certain authorized expenses that are incurred by the concession
16lessee but that are not an obligation of the lessee under the
17terms and conditions of the lease agreement. The Agency may
18allow a reduction of up to 50% of the monthly rent due for the
19purpose of enabling the recoupment of the lessee's authorized
20expenditures during the term of the lease.
21    (k) To sell surplus agricultural products grown on land
22owned by or under the jurisdiction of the Historic Sites and
23Preservation Division of the Agency, when the products cannot
24be used by the Agency.
25    (l) To enforce the laws of the State and the rules and
26regulations of the Agency in or on any lands owned, leased, or

1managed by the Historic Sites and Preservation Division of the
2Agency.
3    (m) To cooperate with private organizations and agencies of
4the State of Illinois by providing areas and the use of staff
5personnel where feasible for the sale of publications on the
6historic and cultural heritage of the State and craft items
7made by Illinois craftsmen. These sales shall not conflict with
8existing concession agreements. The Historic Sites and
9Preservation Division of the Agency is authorized to negotiate
10with the organizations and agencies for a portion of the monies
11received from sales to be returned to the Historic Sites and
12Preservation Division of the Agency's Historic Sites Fund for
13the furtherance of interpretive and restoration programs.
14    (n) To establish local bank or savings and loan association
15accounts, upon the written authorization of the Director, to
16temporarily hold income received at any of its properties. The
17local accounts established under this Section shall be in the
18name of the Historic Preservation Agency and shall be subject
19to regular audits. The balance in a local bank or savings and
20loan association account shall be forwarded to the Agency for
21deposit with the State Treasurer on Monday of each week if the
22amount to be deposited in a fund exceeds $500.
23    No bank or savings and loan association shall receive
24public funds as permitted by this Section, unless it has
25complied with the requirements established under Section 6 of
26the Public Funds Investment Act.

1    (o) To accept, with the consent of the Board, offers of
2gifts, gratuities, or grants from the federal government, its
3agencies, or offices, or from any person, firm, or corporation.
4    (p) To make reasonable rules and regulations as may be
5necessary to discharge the duties of the Agency.
6    (q) With appropriate cultural organizations, to further
7and advance the goals of the Agency.
8    (r) To make grants for the purposes of planning, survey,
9rehabilitation, restoration, reconstruction, landscaping, and
10acquisition of Illinois properties (i) designated individually
11in the National Register of Historic Places, (ii) designated as
12a landmark under a county or municipal landmark ordinance, or
13(iii) located within a National Register of Historic Places
14historic district or a locally designated historic district
15when the Director determines that the property is of historic
16significance whenever an appropriation is made therefor by the
17General Assembly or whenever gifts or grants are received for
18that purpose and to promulgate regulations as may be necessary
19or desirable to carry out the purposes of the grants.
20    Grantees may, as prescribed by rule, be required to provide
21matching funds for each grant. Grants made under this
22subsection shall be known as Illinois Heritage Grants.
23    Every owner of a historic property, or the owner's agent,
24is eligible to apply for a grant under this subsection.
25    (s) To establish and implement a pilot program for charging
26admission to State historic sites. Fees may be charged for

1special events, admissions, and parking or any combination;
2fees may be charged at all sites or selected sites. All fees
3shall be deposited into the Illinois Historic Sites Fund. The
4Historic Sites and Preservation Division of the Agency shall
5have the discretion to set and adjust reasonable fees at the
6various sites, taking into consideration various factors
7including but not limited to: cost of services furnished to
8each visitor, impact of fees on attendance and tourism and the
9costs expended collecting the fees. The Agency shall keep
10careful records of the income and expenses resulting from the
11imposition of fees, shall keep records as to the attendance at
12each historic site, and shall report to the Governor and
13General Assembly by January 31 after the close of each year.
14The report shall include information on costs, expenses,
15attendance, comments by visitors, and any other information the
16Agency may believe pertinent, including:
17        (1) Recommendations as to whether fees should be
18    continued at each State historic site.
19        (2) How the fees should be structured and imposed.
20        (3) Estimates of revenues and expenses associated with
21    each site.
22    (t) To provide for overnight tent and trailer campsites and
23to provide suitable housing facilities for student and juvenile
24overnight camping groups. The Historic Sites and Preservation
25Division of the Agency shall charge rates similar to those
26charged by the Department of Conservation for the same or

1similar facilities and services.
2    (u) To engage in marketing activities designed to promote
3the sites and programs administered by the Agency. In
4undertaking these activities, the Agency may take all necessary
5steps with respect to products and services, including but not
6limited to retail sales, wholesale sales, direct marketing,
7mail order sales, telephone sales, advertising and promotion,
8purchase of product and materials inventory, design, printing
9and manufacturing of new products, reproductions, and
10adaptations, copyright and trademark licensing and royalty
11agreements, and payment of applicable taxes. In addition, the
12Agency shall have the authority to sell advertising in its
13publications and printed materials. All income from marketing
14activities shall be deposited into the Illinois Historic Sites
15Fund.

18    Sec. 22. Amistad Commission.
19    (a) Purpose. The General Assembly finds and declares that
20all people should know of and remember the human carnage and
21dehumanizing atrocities committed during the period of the
22African slave trade and slavery in America and of the vestiges
23of slavery in this country; and it is in fact vital to educate
24our citizens on these events, the legacy of slavery, the sad
25history of racism in this country, and the principles of human

1rights and dignity in a civilized society.
2    It is the policy of the State of Illinois that the history
3of the African slave trade, slavery in America, the depth of
4their impact in our society, and the triumphs of
5African-Americans and their significant contributions to the
6development of this country is the proper concern of all
7people, particularly students enrolled in the schools of the
8State of Illinois.
9    It is therefore desirable to create a Commission that, as
10an organized body and on a continuous basis, will survey,
11design, encourage, and promote the implementation of education
12and awareness programs in Illinois that are concerned with the
13African slave trade, slavery in America, the vestiges of
14slavery in this country, and the contributions of
15African-Americans in building our country; to develop
16workshops, institutes, seminars, and other teacher training
17activities designed to educate teachers on this subject matter;
18and that will be responsible for the coordination of events on
19a regular basis, throughout the State, that provide appropriate
20memorialization of the events concerning the enslavement of
21Africans and their descendants in America and their struggle
22for freedom, liberty, and equality.
23    (b) Amistad Commission. The Amistad Commission is created
24within the Agency. The Commission is named to honor the group
25of enslaved Africans transported in 1839 on a vessel named the
26Amistad who overthrew their captors and created an

1international incident that was eventually argued before the
2Supreme Court and that shed a growing light on the evils of the
3slave trade and galvanized a growing abolitionist movement
4towards demanding the end of slavery in the United States.
5    (c) Membership. The Commission shall consist of 15 members,
6including 3 ex officio members: the State Superintendent of
7Education or his or her designee, the Director of Commerce and
8Economic Opportunity or his or her designee, and the Director
9of the Historic Sites and Preservation Agency or his or her
10designee; and 12 public members. Public members shall be
11appointed as follows:
12        (i) 2 members appointed by the President of the Senate
13    and one member appointed by the Minority Leader of the
14    Senate;
15        (ii) 2 members appointed by the Speaker of the House of
16    Representatives and one member appointed by the Minority
17    Leader of the House of Representatives; and
18        (iii) 6 members, no more than 4 of whom shall be of the
19    same political party, appointed by the Governor.
20    The public members shall be residents of this State, chosen
21with due regard to broad geographic representation and ethnic
22diversity, who have served actively in organizations that
23educate the public on the history of the African slave trade,
24the contributions of African-Americans to our society, and
25civil rights issues.
26    Each public member of the Commission shall serve for a term

1of 3 years, except that of the initial members so appointed:
2one member appointed by the President of the Senate, one member
3appointed by the Speaker of the House of Representatives, and 2
4members appointed by the Governor shall serve for terms of one
5year; the member appointed by the Minority Leader of the
6Senate, one member appointed by the Speaker of the House of
7Representatives, and 2 members appointed by the Governor shall
8serve for terms of 2 years; and one member appointed by the
9President of the Senate, the member appointed by the Minority
10Leader of the House of Representatives, and 2 members appointed
11by the Governor shall serve for terms of 3 years. Public
12members shall be eligible for reappointment. They shall serve
13until their successors are appointed and qualified, and the
14term of the successor of any incumbent shall be calculated from
15the expiration of the term of that incumbent. A vacancy
16occurring other than by expiration of term shall be filled in
17the same manner as the original appointment, but for the
18unexpired term only.
19    (d) Election of chairperson; meetings. At its first meeting
20and annually thereafter, the Commission shall elect from among
21its members a chairperson and other officers it considers
22necessary or appropriate. After its first meeting, the
23Commission shall meet at least quarterly, or more frequently at
24the call of the chairperson or if requested by 9 or more
25members.
26    (e) Quorum. A majority of the members of the Commission

1constitute a quorum for the transaction of business at a
2meeting of the Commission. A majority of the members present
3and serving is required for official action of the Commission.
4    (f) Public meeting. All business that the Commission is
5authorized to perform shall be conducted at a public meeting of
6the Commission, held in compliance with the Open Meetings Act.
7    (g) Freedom of Information. A writing prepared, owned,
8used, in the possession of, or retained by the Commission in
9the performance of an official function is subject to the
10Freedom of Information Act.
11    (h) Compensation. The members of the Commission shall serve
12without compensation, but shall be entitled to reimbursement
13for all necessary expenses incurred in the performance of their
14official duties as members of the Commission from funds
15appropriated for that purpose. Reimbursement for travel,
16meals, and lodging shall be in accordance with the rules of the
17Governor's Travel Control Board.
18    (i) Duties. The Commission shall have the following
19responsibilities and duties:
20        (1) To provide, based upon the collective interest of
21    the members and the knowledge and experience of the
22    members, assistance and advice to schools within the State
23    with respect to the implementation of education, awareness
24    programs, textbooks, and educational materials concerned
25    with the African slave trade, slavery in America, the
26    vestiges of slavery in this country, and the contributions

1    of African-Americans to our society.
2        (2) To survey and catalog the extent and breadth of
3    education concerning the African slave trade, slavery in
4    America, the vestiges of slavery in this country, and the
5    contributions of African-Americans to our society
6    presently being incorporated into the curricula and
7    textbooks and taught in the school systems of the State; to
8    inventory those African slave trade, American slavery, or
9    relevant African-American history memorials, exhibits, and
10    resources that should be incorporated into courses of study
11    at educational institutions, schools, and various other
12    locations throughout the State; and to assist the State
13    Board of Education and other State and educational agencies
14    in the development and implementation of African slave
15    trade, American slavery, and African-American history
16    education programs.
17        (3) To act as a liaison with textbook publishers,
18    schools, public, private, and nonprofit resource
19    organizations, and members of the United States Senate and
20    House of Representatives and the Illinois Senate and House
21    of Representatives in order to facilitate the inclusion of
22    the history of African slavery and of African-Americans in
23    this country in the curricula of public and nonpublic
24    schools.
25        (4) To compile a roster of individual volunteers who
26    are willing to share their knowledge and experience in

1    classrooms, seminars, and workshops with students and
2    teachers on the subject of the African slave trade,
3    American slavery, the impact of slavery on our society
4    today, and the contributions of African-Americans to our
5    country.
6        (5) To coordinate events memorializing the African
7    slave trade, American slavery, and the history of
8    African-Americans in this country that reflect the
9    contributions of African-Americans in overcoming the
10    burdens of slavery and its vestiges, and to seek volunteers
11    who are willing and able to participate in commemorative
12    events that will enhance student awareness of the
13    significance of the African slave trade, American slavery,
14    its historical impact, and the struggle for freedom.
15        (6) To prepare reports for the Governor and the General
16    Assembly regarding its findings and recommendations on
17    facilitating the inclusion of the African slave trade,
18    American slavery studies, African-American history, and
19    special programs in the educational system of the State.
20        (7) To develop, in consultation with the State Board of
21    Education, curriculum guidelines that will be made
22    available to every school board for the teaching of
23    information on the African slave trade, slavery in America,
24    the vestiges of slavery in this country, and the
25    contributions of African-Americans to our country.
26        (8) To solicit, receive, and accept appropriations,

1    gifts, and donations for Commission operations and
2    programs authorized under this Section.
3    (j) Commission requests for assistance. The Commission is
4authorized to call upon any department, office, division, or
5agency of the State, or of any county, municipality, or school
6district of the State, to supply such data, program reports,
7and other information, appropriate school personnel, and
8assistance as it deems necessary to discharge its
9responsibilities under this Act. These departments, offices,
10divisions, and agencies shall, to the extent possible and not
11inconsistent with any other law of this State, cooperate with
12the Commission and shall furnish it with such information,
13appropriate school personnel, and assistance as may be
14necessary or helpful to accomplish the purposes of this Act.
15    (k) State Board of Education assistance. The State Board of
16Education shall:
17        (1) Assist the Amistad Commission in marketing and
18    distributing to educators, administrators, and school
19    districts in the State educational information and other
20    materials on the African slave trade, slavery in America,
21    the vestiges of slavery in this country, and the
22    contributions of African-Americans to our society.
23        (2) Conduct at least one teacher workshop annually on
24    the African slave trade, slavery in America, the vestiges
25    of slavery in this country, and the contributions of
26    African-Americans to our society.

1        (3) Assist the Amistad Commission in monitoring the
2    inclusion of slavery materials and curricula in the State's
3    educational system.
4        (4) Consult with the Amistad Commission to determine
5    ways it may survey, catalog, and extend slave trade and
6    American slavery education presently being taught in the
7    State's educational system.
8    The State Board of Education may, subject to the
9availability of appropriations, hire additional staff and
10consultants to carry out the duties and responsibilities
11provided within this subsection (k).
12    (l) Report. The Commission shall report its activities and
13findings, as required under subsection (i), to the Governor and
14General Assembly on or before June 30, 2006, and biannually
15thereafter.

18    Sec. 34. Internal Auditor. There is created the Office of
19the Internal Auditor of the Historic Preservation Agency. The
20Internal Auditor shall be appointed by the Board, shall serve
21at the pleasure of the Board, and shall report to the Board.
22The Internal Auditor shall audit and maintain the financial
23books, records, papers, and transactions of the Lincoln
24Presidential Library and the Historic Sites and Preservation
25Division of the Historic Preservation Agency. The Internal

1Auditor shall prepare an annual report for each fiscal year of
2the operations of the Historic Preservation Agency, which shall
3be submitted to the Board, the General Assembly, and the
4Governor. Nothing in this Section shall abridge the authority
5of the Illinois Auditor General to independently audit the
6Illinois Historic Preservation Agency or any of the libraries,
7divisions, or offices contained within the Agency.

9    Section 55. The State Historical Library Act is amended by
10changing Section 5.1 as follows:
 
11    (20 ILCS 3425/5.1)  (from Ch. 128, par. 16.1)
12    Sec. 5.1. The State Historian shall establish and supervise
13a program within the Abraham Lincoln Presidential Library
14designed to preserve as historical records selected past
15editions of newspapers of this State. Such editions shall be
16microphotographed. The negatives of such microphotographs
17shall be stored in a place provided by the Abraham Lincoln
18Presidential Library.
19    The State Historian shall determine on the basis of
20historical value the various newspaper edition files which
21shall be microphotographed and shall arrange a schedule for
22such microphotographing. The State Historian shall supervise
23the making of arrangements for acquiring access to past edition
24files with the editors or publishers of the various newspapers.

1    The method of microphotography to be employed in this
2program shall conform to the standards established pursuant to
3Section 17 of "The State Records Act", approved July 6, 1957.
4    Upon payment to the Abraham Lincoln Presidential Library of
5the required fee, any person or organization shall be supplied
6with any prints requested to be made from the negatives of the
7microphotographs. The fee required shall be determined by the
8State Historian and shall be equal in amount to the cost
9incurred by the Lincoln Presidential Library in supplying the
10requested prints.

12    Section 60. The Liquor Control Act of 1934 is amended by
13changing Section 6-15 as follows:
 
14    (235 ILCS 5/6-15)  (from Ch. 43, par. 130)
15    Sec. 6-15. No alcoholic liquors shall be sold or delivered
16in any building belonging to or under the control of the State
17or any political subdivision thereof except as provided in this
18Act. The corporate authorities of any city, village,
19incorporated town, township, or county may provide by
20ordinance, however, that alcoholic liquor may be sold or
21delivered in any specifically designated building belonging to
22or under the control of the municipality, township, or county,
23or in any building located on land under the control of the
24municipality, township, or county; provided that such township

1or county complies with all applicable local ordinances in any
2incorporated area of the township or county. Alcoholic liquor
3may be delivered to and sold under the authority of a special
4use permit on any property owned by a conservation district
5organized under the Conservation District Act, provided that
6(i) the alcoholic liquor is sold only at an event authorized by
7the governing board of the conservation district, (ii) the
8issuance of the special use permit is authorized by the local
9liquor control commissioner of the territory in which the
10property is located, and (iii) the special use permit
11authorizes the sale of alcoholic liquor for one day or less.
12Alcoholic liquors may be delivered to and sold at any airport
13belonging to or under the control of a municipality of more
14than 25,000 inhabitants, or in any building or on any golf
15course owned by a park district organized under the Park
16District Code, subject to the approval of the governing board
17of the district, or in any building or on any golf course owned
18by a forest preserve district organized under the Downstate
19Forest Preserve District Act, subject to the approval of the
20governing board of the district, or on the grounds within 500
21feet of any building owned by a forest preserve district
22organized under the Downstate Forest Preserve District Act
23during times when food is dispensed for consumption within 500
24feet of the building from which the food is dispensed, subject
25to the approval of the governing board of the district, or in a
26building owned by a Local Mass Transit District organized under

1the Local Mass Transit District Act, subject to the approval of
2the governing Board of the District, or in Bicentennial Park,
3or on the premises of the City of Mendota Lake Park located

6owned by the City of Loves Park that is located at 1000 River
7Park Drive in Loves Park, Illinois, or, in connection with the
8operation of an established food serving facility during times
9when food is dispensed for consumption on the premises, and at
10the following aquarium and museums located in public parks: Art
11Institute of Chicago, Chicago Academy of Sciences, Chicago
12Historical Society, Field Museum of Natural History, Museum of
13Science and Industry, DuSable Museum of African American
14History, John G. Shedd Aquarium and Adler Planetarium, or at
15Lakeview Museum of Arts and Sciences in Peoria, or in
16connection with the operation of the facilities of the Chicago
17Zoological Society or the Chicago Horticultural Society on land
18owned by the Forest Preserve District of Cook County, or on any
19land used for a golf course or for recreational purposes owned
20by the Forest Preserve District of Cook County, subject to the
21control of the Forest Preserve District Board of Commissioners
22and applicable local law, provided that dram shop liability
23insurance is provided at maximum coverage limits so as to hold
24the District harmless from all financial loss, damage, and
25harm, or in any building located on land owned by the Chicago
26Park District if approved by the Park District Commissioners,

1or on any land used for a golf course or for recreational
2purposes and owned by the Illinois International Port District
3if approved by the District's governing board, or at any
4airport, golf course, faculty center, or facility in which

7college district, provided that with respect to a facility for
8conference and convention type activities alcoholic liquors
9shall be limited to the use of the convention or conference
10participants or participants in cultural, political or
11educational activities held in such facilities, and provided
12further that the faculty or staff of the State university or a
13public community college district, or members of an
14organization of students, alumni, faculty or staff of the State
15university or a public community college district are active
16participants in the conference or convention, or in Memorial
17Stadium on the campus of the University of Illinois at
18Urbana-Champaign during games in which the Chicago Bears
19professional football team is playing in that stadium during
20the renovation of Soldier Field, not more than one and a half
21hours before the start of the game and not after the end of the
22third quarter of the game, or in the Pavilion Facility on the
23campus of the University of Illinois at Chicago during games in
24which the Chicago Storm professional soccer team is playing in
25that facility, not more than one and a half hours before the
26start of the game and not after the end of the third quarter of

1the game, or in the Pavilion Facility on the campus of the
2University of Illinois at Chicago during games in which the
3WNBA professional women's basketball team is playing in that
4facility, not more than one and a half hours before the start
5of the game and not after the 10-minute mark of the second half
6of the game, or by a catering establishment which has rented
7facilities from a board of trustees of a public community
8college district, or in a restaurant that is operated by a
9commercial tenant in the North Campus Parking Deck building
10that (1) is located at 1201 West University Avenue, Urbana,
11Illinois and (2) is owned by the Board of Trustees of the
12University of Illinois, or, if approved by the District board,
13on land owned by the Metropolitan Sanitary District of Greater
14Chicago and leased to others for a term of at least 20 years.
15Nothing in this Section precludes the sale or delivery of
16alcoholic liquor in the form of original packaged goods in
17premises located at 500 S. Racine in Chicago belonging to the
18University of Illinois and used primarily as a grocery store by
19a commercial tenant during the term of a lease that predates
20the University's acquisition of the premises; but the
21University shall have no power or authority to renew, transfer,
22or extend the lease with terms allowing the sale of alcoholic
23liquor; and the sale of alcoholic liquor shall be subject to
24all local laws and regulations. After the acquisition by
25Winnebago County of the property located at 404 Elm Street in
26Rockford, a commercial tenant who sold alcoholic liquor at

1retail on a portion of the property under a valid license at
2the time of the acquisition may continue to do so for so long
3as the tenant and the County may agree under existing or future
4leases, subject to all local laws and regulations regarding the
5sale of alcoholic liquor. Alcoholic liquors may be delivered to
6and sold at Memorial Hall, located at 211 North Main Street,
7Rockford, under conditions approved by Winnebago County and
8subject to all local laws and regulations regarding the sale of
9alcoholic liquor. Each facility shall provide dram shop
10liability in maximum insurance coverage limits so as to save
11harmless the State, municipality, State university, airport,
12golf course, faculty center, facility in which conference and
13convention type activities take place, park district, Forest
14Preserve District, public community college district,
15aquarium, museum, or sanitary district from all financial loss,
16damage or harm. Alcoholic liquors may be sold at retail in
17buildings of golf courses owned by municipalities or Illinois
18State University in connection with the operation of an
19established food serving facility during times when food is
20dispensed for consumption upon the premises. Alcoholic liquors
21may be delivered to and sold at retail in any building owned by
22a fire protection district organized under the Fire Protection
23District Act, provided that such delivery and sale is approved
24by the board of trustees of the district, and provided further
25that such delivery and sale is limited to fundraising events
26and to a maximum of 6 events per year. However, the limitation

1to fundraising events and to a maximum of 6 events per year
2does not apply to the delivery, sale, or manufacture of
3alcoholic liquors at the building located at 59 Main Street in
4Oswego, Illinois, owned by the Oswego Fire Protection District
5if the alcoholic liquor is sold or dispensed as approved by the
6Oswego Fire Protection District and the property is no longer
7being utilized for fire protection purposes.
8    Alcoholic liquors may be served or sold in buildings under
9the control of the Board of Trustees of the University of
10Illinois for events that the Board may determine are public
11events and not related student activities. The Board of
12Trustees shall issue a written policy within 6 months of the
13effective date of this amendatory Act of the 95th General
14Assembly concerning the types of events that would be eligible
15for an exemption. Thereafter, the Board of Trustees may issue
16revised, updated, new, or amended policies as it deems
17necessary and appropriate. In preparing its written policy, the
18Board of Trustees shall, among other factors it considers
19relevant and important, give consideration to the following:
20(i) whether the event is a student activity or student related
21activity; (ii) whether the physical setting of the event is
22conducive to control of liquor sales and distribution; (iii)
23the ability of the event operator to ensure that the sale or
24serving of alcoholic liquors and the demeanor of the
25participants are in accordance with State law and University
26policies; (iv) regarding the anticipated attendees at the

1event, the relative proportion of individuals under the age of
221 to individuals age 21 or older; (v) the ability of the venue
3operator to prevent the sale or distribution of alcoholic
4liquors to individuals under the age of 21; (vi) whether the
5event prohibits participants from removing alcoholic beverages
6from the venue; and (vii) whether the event prohibits
7participants from providing their own alcoholic liquors to the
8venue. In addition, any policy submitted by the Board of
9Trustees to the Illinois Liquor Control Commission must require
10that any event at which alcoholic liquors are served or sold in
11buildings under the control of the Board of Trustees shall
12require the prior written approval of the Office of the
13Chancellor for the University campus where the event is
14located. The Board of Trustees shall submit its policy, and any
15subsequently revised, updated, new, or amended policies, to the
16Illinois Liquor Control Commission, and any University event,
17or location for an event, exempted under such policies shall
18apply for a license under the applicable Sections of this Act.
19    Alcoholic liquors may be served or sold in buildings under
20the control of the Board of Trustees of Northern Illinois
21University for events that the Board may determine are public
22events and not student-related activities. The Board of
23Trustees shall issue a written policy within 6 months after
24June 28, 2011 (the effective date of Public Act 97-45)
25concerning the types of events that would be eligible for an
26exemption. Thereafter, the Board of Trustees may issue revised,

1updated, new, or amended policies as it deems necessary and
2appropriate. In preparing its written policy, the Board of
3Trustees shall, in addition to other factors it considers
4relevant and important, give consideration to the following:
5(i) whether the event is a student activity or student-related
6activity; (ii) whether the physical setting of the event is
7conducive to control of liquor sales and distribution; (iii)
8the ability of the event operator to ensure that the sale or
9serving of alcoholic liquors and the demeanor of the
10participants are in accordance with State law and University
11policies; (iv) the anticipated attendees at the event and the
12relative proportion of individuals under the age of 21 to
13individuals age 21 or older; (v) the ability of the venue
14operator to prevent the sale or distribution of alcoholic
15liquors to individuals under the age of 21; (vi) whether the
16event prohibits participants from removing alcoholic beverages
17from the venue; and (vii) whether the event prohibits
18participants from providing their own alcoholic liquors to the
19venue.
20    Alcoholic liquors may be served or sold in buildings under
21the control of the Board of Trustees of Chicago State
22University for events that the Board may determine are public
23events and not student-related activities. The Board of
24Trustees shall issue a written policy within 6 months after
25August 2, 2013 (the effective date of Public Act 98-132) this
26amendatory Act of the 98th General Assembly concerning the

1types of events that would be eligible for an exemption.
2Thereafter, the Board of Trustees may issue revised, updated,
3new, or amended policies as it deems necessary and appropriate.
4In preparing its written policy, the Board of Trustees shall,
5in addition to other factors it considers relevant and
6important, give consideration to the following: (i) whether the
7event is a student activity or student-related activity; (ii)
8whether the physical setting of the event is conducive to
9control of liquor sales and distribution; (iii) the ability of
10the event operator to ensure that the sale or serving of
11alcoholic liquors and the demeanor of the participants are in
12accordance with State law and University policies; (iv) the
13anticipated attendees at the event and the relative proportion
14of individuals under the age of 21 to individuals age 21 or
15older; (v) the ability of the venue operator to prevent the
16sale or distribution of alcoholic liquors to individuals under
17the age of 21; (vi) whether the event prohibits participants
18from removing alcoholic beverages from the venue; and (vii)
19whether the event prohibits participants from providing their
20own alcoholic liquors to the venue.
21    Alcoholic liquors may be served or sold in buildings under
22the control of the Board of Trustees of Illinois State
23University for events that the Board may determine are public
24events and not student-related activities. The Board of
25Trustees shall issue a written policy within 6 months after the
26effective date of this amendatory Act of the 97th General

1Assembly concerning the types of events that would be eligible
2for an exemption. Thereafter, the Board of Trustees may issue
3revised, updated, new, or amended policies as it deems
4necessary and appropriate. In preparing its written policy, the
5Board of Trustees shall, in addition to other factors it
6considers relevant and important, give consideration to the
7following: (i) whether the event is a student activity or
8student-related activity; (ii) whether the physical setting of
9the event is conducive to control of liquor sales and
10distribution; (iii) the ability of the event operator to ensure
11that the sale or serving of alcoholic liquors and the demeanor
12of the participants are in accordance with State law and
13University policies; (iv) the anticipated attendees at the
14event and the relative proportion of individuals under the age
15of 21 to individuals age 21 or older; (v) the ability of the
16venue operator to prevent the sale or distribution of alcoholic
17liquors to individuals under the age of 21; (vi) whether the
18event prohibits participants from removing alcoholic beverages
19from the venue; and (vii) whether the event prohibits
20participants from providing their own alcoholic liquors to the
21venue.
22    Alcoholic liquor may be delivered to and sold at retail in
23the Dorchester Senior Business Center owned by the Village of
24Dolton if the alcoholic liquor is sold or dispensed only in
25connection with organized functions for which the planned
26attendance is 20 or more persons, and if the person or facility

1selling or dispensing the alcoholic liquor has provided dram
2shop liability insurance in maximum limits so as to hold
3harmless the Village of Dolton and the State from all financial
4loss, damage and harm.
5    Alcoholic liquors may be delivered to and sold at retail in
6any building used as an Illinois State Armory provided:
7        (i) the Adjutant General's written consent to the
8    issuance of a license to sell alcoholic liquor in such
9    building is filed with the Commission;
10        (ii) the alcoholic liquor is sold or dispensed only in
11    connection with organized functions held on special
12    occasions;
13        (iii) the organized function is one for which the
14    planned attendance is 25 or more persons; and
15        (iv) the facility selling or dispensing the alcoholic
16    liquors has provided dram shop liability insurance in
17    maximum limits so as to save harmless the facility and the
18    State from all financial loss, damage or harm.
19    Alcoholic liquors may be delivered to and sold at retail in
20the Chicago Civic Center, provided that:
21        (i) the written consent of the Public Building
22    Commission which administers the Chicago Civic Center is
23    filed with the Commission;
24        (ii) the alcoholic liquor is sold or dispensed only in
25    connection with organized functions held on special
26    occasions;

1        (iii) the organized function is one for which the
2    planned attendance is 25 or more persons;
3        (iv) the facility selling or dispensing the alcoholic
4    liquors has provided dram shop liability insurance in
5    maximum limits so as to hold harmless the Civic Center, the
6    City of Chicago and the State from all financial loss,
7    damage or harm; and
8        (v) all applicable local ordinances are complied with.
9    Alcoholic liquors may be delivered or sold in any building
10belonging to or under the control of any city, village or
11incorporated town where more than 75% of the physical
12properties of the building is used for commercial or
13recreational purposes, and the building is located upon a pier
14extending into or over the waters of a navigable lake or stream
15or on the shore of a navigable lake or stream. In accordance
16with a license issued under this Act, alcoholic liquor may be
17sold, served, or delivered in buildings and facilities under
18the control of the Department of Natural Resources during
19events or activities lasting no more than 7 continuous days
20upon the written approval of the Director of Natural Resources
21acting as the controlling government authority. The Director of
22Natural Resources may specify conditions on that approval,
23including but not limited to requirements for insurance and
24hours of operation. Notwithstanding any other provision of this
25Act, alcoholic liquor sold by a United States Army Corps of
26Engineers or Department of Natural Resources concessionaire

1who was operating on June 1, 1991 for on-premises consumption
2only is not subject to the provisions of Articles IV and IX.
3Beer and wine may be sold on the premises of the Joliet Park
4District Stadium owned by the Joliet Park District when written
5consent to the issuance of a license to sell beer and wine in
6such premises is filed with the local liquor commissioner by
7the Joliet Park District. Beer and wine may be sold in
8buildings on the grounds of State veterans' homes when written
9consent to the issuance of a license to sell beer and wine in
10such buildings is filed with the Commission by the Department
11of Veterans' Affairs, and the facility shall provide dram shop
12liability in maximum insurance coverage limits so as to save
13the facility harmless from all financial loss, damage or harm.
14Such liquors may be delivered to and sold at any property owned
15or held under lease by a Metropolitan Pier and Exposition
16Authority or Metropolitan Exposition and Auditorium Authority.
17    Beer and wine may be sold and dispensed at professional
18sporting events and at professional concerts and other
19entertainment events conducted on premises owned by the Forest
20Preserve District of Kane County, subject to the control of the
21District Commissioners and applicable local law, provided that
22dram shop liability insurance is provided at maximum coverage
23limits so as to hold the District harmless from all financial
24loss, damage and harm.
25    Nothing in this Section shall preclude the sale or delivery
26of beer and wine at a State or county fair or the sale or

1delivery of beer or wine at a city fair in any otherwise lawful
2manner.
3    Alcoholic liquors may be sold at retail in buildings in
4State parks under the control of the Department of Natural
5Resources, provided:
6        a. the State park has overnight lodging facilities with
7    some restaurant facilities or, not having overnight
8    lodging facilities, has restaurant facilities which serve
9    complete luncheon and dinner or supper meals,
10        b. consent to the issuance of a license to sell
11    alcoholic liquors in the buildings has been filed with the
12    commission by the Department of Natural Resources, and
13        c. the alcoholic liquors are sold by the State park
14    lodge or restaurant concessionaire only during the hours
15    from 11 o'clock a.m. until 12 o'clock midnight.
16    Notwithstanding any other provision of this Act, alcoholic
17    liquor sold by the State park or restaurant concessionaire
18    is not subject to the provisions of Articles IV and IX.
19    Alcoholic liquors may be sold at retail in buildings on
20properties under the control of the Historic Sites and
21Preservation Division of the Historic Preservation Agency or
22the Abraham Lincoln Presidential Library and Museum provided:
23        a. the property has overnight lodging facilities with
24    some restaurant facilities or, not having overnight
25    lodging facilities, has restaurant facilities which serve
26    complete luncheon and dinner or supper meals,

1        b. consent to the issuance of a license to sell
2    alcoholic liquors in the buildings has been filed with the
3    commission by the Historic Sites and Preservation Division
4    of the Historic Preservation Agency or the Abraham Lincoln
5    Presidential Library and Museum, and
6        c. the alcoholic liquors are sold by the lodge or
7    restaurant concessionaire only during the hours from 11
8    o'clock a.m. until 12 o'clock midnight.
9    The sale of alcoholic liquors pursuant to this Section does
10not authorize the establishment and operation of facilities
11commonly called taverns, saloons, bars, cocktail lounges, and
12the like except as a part of lodge and restaurant facilities in
13State parks or golf courses owned by Forest Preserve Districts
14with a population of less than 3,000,000 or municipalities or
15park districts.
16    Alcoholic liquors may be sold at retail in the Springfield
17Administration Building of the Department of Transportation
18and the Illinois State Armory in Springfield; provided, that
19the controlling government authority may consent to such sales
20only if
21        a. the request is from a not-for-profit organization;
22        b. such sales would not impede normal operations of the
23    departments involved;
24        c. the not-for-profit organization provides dram shop
25    liability in maximum insurance coverage limits and agrees
26    to defend, save harmless and indemnify the State of

1    Illinois from all financial loss, damage or harm;
2        d. no such sale shall be made during normal working
3    hours of the State of Illinois; and
4        e. the consent is in writing.
5    Alcoholic liquors may be sold at retail in buildings in
6recreational areas of river conservancy districts under the
7control of, or leased from, the river conservancy districts.
8Such sales are subject to reasonable local regulations as
9provided in Article IV; however, no such regulations may
10prohibit or substantially impair the sale of alcoholic liquors
11on Sundays or Holidays.
12    Alcoholic liquors may be provided in long term care
13facilities owned or operated by a county under Division 5-21 or
145-22 of the Counties Code, when approved by the facility
15operator and not in conflict with the regulations of the
16Illinois Department of Public Health, to residents of the
17facility who have had their consumption of the alcoholic
18liquors provided approved in writing by a physician licensed to
19practice medicine in all its branches.
20    Alcoholic liquors may be delivered to and dispensed in
21State housing assigned to employees of the Department of
22Corrections. No person shall furnish or allow to be furnished
23any alcoholic liquors to any prisoner confined in any jail,
24reformatory, prison or house of correction except upon a
25physician's prescription for medicinal purposes.
26    Alcoholic liquors may be sold at retail or dispensed at the

1Willard Ice Building in Springfield, at the State Library in
2Springfield, and at Illinois State Museum facilities by (1) an
3agency of the State, whether legislative, judicial or
4executive, provided that such agency first obtains written
5permission to sell or dispense alcoholic liquors from the
6controlling government authority, or by (2) a not-for-profit
7organization, provided that such organization:
8        a. Obtains written consent from the controlling
9    government authority;
10        b. Sells or dispenses the alcoholic liquors in a manner
11    that does not impair normal operations of State offices
12    located in the building;
13        c. Sells or dispenses alcoholic liquors only in
14    connection with an official activity in the building;
15        d. Provides, or its catering service provides, dram
16    shop liability insurance in maximum coverage limits and in
17    which the carrier agrees to defend, save harmless and
18    indemnify the State of Illinois from all financial loss,
19    damage or harm arising out of the selling or dispensing of
20    alcoholic liquors.
21    Nothing in this Act shall prevent a not-for-profit
22organization or agency of the State from employing the services
23of a catering establishment for the selling or dispensing of
24alcoholic liquors at authorized functions.
25    The controlling government authority for the Willard Ice
26Building in Springfield shall be the Director of the Department

1of Revenue. The controlling government authority for Illinois
2State Museum facilities shall be the Director of the Illinois
3State Museum. The controlling government authority for the
4State Library in Springfield shall be the Secretary of State.
5    Alcoholic liquors may be delivered to and sold at retail or
6dispensed at any facility, property or building under the
7jurisdiction of the Historic Sites and Preservation Division of
8the Historic Preservation Agency or the Abraham Lincoln
9Presidential Library and Museum where the delivery, sale or
10dispensing is by (1) an agency of the State, whether
11legislative, judicial or executive, provided that such agency
12first obtains written permission to sell or dispense alcoholic
13liquors from a controlling government authority, or by (2) an
14individual or organization provided that such individual or
15organization:
16        a. Obtains written consent from the controlling
17    government authority;
18        b. Sells or dispenses the alcoholic liquors in a manner
19    that does not impair normal workings of State offices or
20    operations located at the facility, property or building;
21        c. Sells or dispenses alcoholic liquors only in
22    connection with an official activity of the individual or
23    organization in the facility, property or building;
24        d. Provides, or its catering service provides, dram
25    shop liability insurance in maximum coverage limits and in
26    which the carrier agrees to defend, save harmless and

1    indemnify the State of Illinois from all financial loss,
2    damage or harm arising out of the selling or dispensing of
3    alcoholic liquors.
4    The controlling government authority for the Historic
5Sites and Preservation Division of the Historic Preservation
6Agency shall be the Director of the Historic Sites and
7Preservation Agency, and the controlling government authority
8for the Abraham Lincoln Presidential Library and Museum shall
9be the Executive Director of the Abraham Lincoln Presidential
10Library and Museum.
11    Alcoholic liquors may be delivered to and sold at retail or
12dispensed for consumption at the Michael Bilandic Building at
13160 North LaSalle Street, Chicago IL 60601, after the normal
14business hours of any day care or child care facility located
15in the building, by (1) a commercial tenant or subtenant
16conducting business on the premises under a lease made pursuant
17to Section 405-315 of the Department of Central Management
18Services Law (20 ILCS 405/405-315), provided that such tenant
19or subtenant who accepts delivery of, sells, or dispenses
20alcoholic liquors shall procure and maintain dram shop
21liability insurance in maximum coverage limits and in which the
22carrier agrees to defend, indemnify, and save harmless the
23State of Illinois from all financial loss, damage, or harm
24arising out of the delivery, sale, or dispensing of alcoholic
25liquors, or by (2) an agency of the State, whether legislative,
26judicial, or executive, provided that such agency first obtains

1written permission to accept delivery of and sell or dispense
2alcoholic liquors from the Director of Central Management
3Services, or by (3) a not-for-profit organization, provided
4that such organization:

7        b. accepts delivery of and sells or dispenses the
8    alcoholic liquors in a manner that does not impair normal
9    operations of State offices located in the building;
10        c. accepts delivery of and sells or dispenses alcoholic
11    liquors only in connection with an official activity in the
12    building; and
13        d. provides, or its catering service provides, dram
14    shop liability insurance in maximum coverage limits and in
15    which the carrier agrees to defend, save harmless, and
16    indemnify the State of Illinois from all financial loss,
17    damage, or harm arising out of the selling or dispensing of
18    alcoholic liquors.
19    Nothing in this Act shall prevent a not-for-profit
20organization or agency of the State from employing the services
21of a catering establishment for the selling or dispensing of
22alcoholic liquors at functions authorized by the Director of
23Central Management Services.
24    Alcoholic liquors may be sold at retail or dispensed at the
25James R. Thompson Center in Chicago, subject to the provisions
26of Section 7.4 of the State Property Control Act, and 222 South

1College Street in Springfield, Illinois by (1) a commercial
2tenant or subtenant conducting business on the premises under a
3lease or sublease made pursuant to Section 405-315 of the

6or dispenses alcoholic liquors shall procure and maintain dram
7shop liability insurance in maximum coverage limits and in
8which the carrier agrees to defend, indemnify and save harmless
9the State of Illinois from all financial loss, damage or harm
10arising out of the sale or dispensing of alcoholic liquors, or
11by (2) an agency of the State, whether legislative, judicial or
12executive, provided that such agency first obtains written
13permission to sell or dispense alcoholic liquors from the
14Director of Central Management Services, or by (3) a
15not-for-profit organization, provided that such organization:
16        a. Obtains written consent from the Department of
17    Central Management Services;
18        b. Sells or dispenses the alcoholic liquors in a manner
19    that does not impair normal operations of State offices
20    located in the building;
21        c. Sells or dispenses alcoholic liquors only in
22    connection with an official activity in the building;
23        d. Provides, or its catering service provides, dram
24    shop liability insurance in maximum coverage limits and in
25    which the carrier agrees to defend, save harmless and
26    indemnify the State of Illinois from all financial loss,

3    Nothing in this Act shall prevent a not-for-profit

7Central Management Services.
8    Alcoholic liquors may be sold or delivered at any facility
9owned by the Illinois Sports Facilities Authority provided that
10dram shop liability insurance has been made available in a
11form, with such coverage and in such amounts as the Authority
12reasonably determines is necessary.
13    Alcoholic liquors may be sold at retail or dispensed at the
14Rockford State Office Building by (1) an agency of the State,
15whether legislative, judicial or executive, provided that such
16agency first obtains written permission to sell or dispense
17alcoholic liquors from the Department of Central Management
18Services, or by (2) a not-for-profit organization, provided
19that such organization:
20        a. Obtains written consent from the Department of
21    Central Management Services;
22        b. Sells or dispenses the alcoholic liquors in a manner
23    that does not impair normal operations of State offices
24    located in the building;
25        c. Sells or dispenses alcoholic liquors only in
26    connection with an official activity in the building;

1        d. Provides, or its catering service provides, dram
2    shop liability insurance in maximum coverage limits and in
3    which the carrier agrees to defend, save harmless and
4    indemnify the State of Illinois from all financial loss,
5    damage or harm arising out of the selling or dispensing of
6    alcoholic liquors.
7    Nothing in this Act shall prevent a not-for-profit
8organization or agency of the State from employing the services
9of a catering establishment for the selling or dispensing of
10alcoholic liquors at functions authorized by the Department of
11Central Management Services.
12    Alcoholic liquors may be sold or delivered in a building
13that is owned by McLean County, situated on land owned by the
14county in the City of Bloomington, and used by the McLean
15County Historical Society if the sale or delivery is approved
16by an ordinance adopted by the county board, and the
17municipality in which the building is located may not prohibit
18that sale or delivery, notwithstanding any other provision of
19this Section. The regulation of the sale and delivery of
20alcoholic liquor in a building that is owned by McLean County,
21situated on land owned by the county, and used by the McLean
22County Historical Society as provided in this paragraph is an
23exclusive power and function of the State and is a denial and
24limitation under Article VII, Section 6, subsection (h) of the
25Illinois Constitution of the power of a home rule municipality
26to regulate that sale and delivery.

1    Alcoholic liquors may be sold or delivered in any building
2situated on land held in trust for any school district
3organized under Article 34 of the School Code, if the building
4is not used for school purposes and if the sale or delivery is
5approved by the board of education.
6    Alcoholic liquors may be sold or delivered in buildings
7owned by the Community Building Complex Committee of Boone
8County, Illinois if the person or facility selling or
9dispensing the alcoholic liquor has provided dram shop
10liability insurance with coverage and in amounts that the
11Committee reasonably determines are necessary.
12    Alcoholic liquors may be sold or delivered in the building
13located at 1200 Centerville Avenue in Belleville, Illinois and
14occupied by either the Belleville Area Special Education
15District or the Belleville Area Special Services Cooperative.
16    Alcoholic liquors may be delivered to and sold at the Louis
17Joliet Renaissance Center, City Center Campus, located at 214
18N. Ottawa Street, Joliet, and the Food Services/Culinary Arts
19Department facilities, Main Campus, located at 1215 Houbolt
20Road, Joliet, owned by or under the control of Joliet Junior
21College, Illinois Community College District No. 525.
22    Alcoholic liquors may be delivered to and sold at Triton
23College, Illinois Community College District No. 504.
24    Alcoholic liquors may be delivered to and sold at the
25College of DuPage, Illinois Community College District No. 502.
26    Alcoholic liquors may be delivered to and sold at the

1building located at 446 East Hickory Avenue in Apple River,
2Illinois, owned by the Apple River Fire Protection District,
3and occupied by the Apple River Community Association if the
4alcoholic liquor is sold or dispensed only in connection with
5organized functions approved by the Apple River Community
6Association for which the planned attendance is 20 or more
7persons and if the person or facility selling or dispensing the
8alcoholic liquor has provided dram shop liability insurance in
9maximum limits so as to hold harmless the Apple River Fire
10Protection District, the Village of Apple River, and the Apple
11River Community Association from all financial loss, damage,
12and harm.
13    Alcoholic liquors may be delivered to and sold at the Sikia
14Restaurant, Kennedy King College Campus, located at 740 West
1563rd Street, Chicago, and at the Food Services in the Great
16Hall/Washburne Culinary Institute Department facility, Kennedy
17King College Campus, located at 740 West 63rd Street, Chicago,
18owned by or under the control of City Colleges of Chicago,
19Illinois Community College District No. 508.
