AMENDMENT TO HOUSE BILL 3319

2    AMENDMENT NO. ______. Amend House Bill 3319 by replacing
3line 5 on page 11 through line 6 on page 12 with the following:
 
4            "(D) the owner or operator, by January 1, 1990 (or
5        the January 1 following commencement of operation,
6        whichever is later) and January 1 of each year
7        thereafter, (i) registers the site with the Agency,
8        (ii) reports to the Agency on the volume of composting
9        material received and used at the site, (iii) certifies
10        to the Agency that the site complies with the
11        requirements set forth in subparagraphs (A), (A-1),
12        (A-2), (B), and (C) of this paragraph (q)(3), and (iv)
13        certifies to the Agency that all composting material:
14                (I) was placed more than 200 feet from the
15            nearest potable water supply well;
16                (II) , was placed outside the boundary of the
17            10-year floodplain or on a part of the site that is

1            floodproofed;
2                (III) , was placed either (aa) at least 1/4 mile
3            from the nearest residence (other than a residence
4            located on the same property as the facility) and
5            there are not more than 10 occupied non-farm
6            residences within 1/2 mile of the boundaries of the
7            site on the date of application or (bb) a lesser
8            distance from the nearest residence (other than a
9            residence located on the same property as the
10            facility) provided that the municipality or county
11            in which the facility is located has by ordinance
12            approved a lesser distance than 1/4 mile and there
13            are not more than 10 occupied non-farm residences
14            within 1/2 mile of the boundaries of the site on
15            the date of application; , and
16                (IV) was placed more than 5 feet above the
17            water table.
18            Any ordinance approving a residential setback of
19        less than 1/4 mile that is used to meet the
20        requirements of this subparagraph (D) must
21        specifically reference this subparagraph.".
