| 1 | | AN ACT concerning safety.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Public Demonstrations Law is | 5 | | amended by changing Sections 3, 4, 5, and 6 as follows:

| 7 | | Sec. 3.
Unlawful
action-Parade permit.
| 8 | | It is unlawful for any person, group or organization to | 9 | | conduct or
participate in any march, assembly, meeting , parade, | 10 | | or gathering on roadways in
more than one specific area of or | 11 | | location in, any municipality or the
unincorporated area of a | 12 | | county, on any given day, unless it is acting
under authority | 13 | | of a duly issued municipal or county parade or
demonstration | 14 | | permit if local ordinance or regulation requires a such permit,
| 15 | | or, if not, with permission of the principal law enforcement | 16 | | officer for
the such area. Only the person, group, or | 17 | | organization responsible for organizing the march, assembly, | 18 | | meeting, parade, or gathering is required to obtain a permit or | 19 | | the permission of the principal law enforcement officer, which | 20 | | shall be sufficient to encompass all participants. If a march, | 21 | | assembly, meeting, parade, or gathering on roadways involves | 22 | | the act of crossing or traversing over or upon active railroad | 23 | | tracks, the municipal or county authority or principal law |

| 1 | | enforcement officer, as part of its permit or permission | 2 | | process, may prohibit any portion of the route that involves | 3 | | the act of crossing or traversing over or upon active railroad | 4 | | tracks.

| 7 | | Sec. 4. Acting with other groups - Size of assemblage. It | 8 | | is unlawful for any group or organization or any individual | 9 | | acting
with the such group or organization, to conduct or | 10 | | participate in any march,
assembly, meeting , parade, or | 11 | | gathering on roadways unless the such march, assembly,
meeting, | 12 | | parade, or gathering is limited to such numbers that as , in the | 13 | | opinion of
the principal law enforcement officer, will not | 14 | | obstruct pedestrian or
vehicular traffic in an unreasonable | 15 | | manner. The principal law
enforcement officer shall, within 12 | 16 | | hours of receiving the notice
required by Section 5, inform the | 17 | | group or organization as to the
limitation on number of persons | 18 | | allowed to participate.

Notice of
assemblage in writing-Contents.

location, the | 2 | | maximum number of persons participating, and the names and
| 3 | | addresses of the organizers of the any such march, assembly, | 4 | | meeting , parade, or
gathering, its route, and its time of | 5 | | inception and duration at least 24
hours before such inception.

Time of
holding.
| 9 | | It is unlawful for any group, organization, or any | 10 | | individual to conduct
or participate in any march, assembly, | 11 | | meeting , parade, or gathering on roadways
during peak traffic | 12 | | periods unless authorized by the principal law
enforcement | 13 | | officer for the area in which the march, assembly, meeting , | 14 | | parade, or
gathering is to be held. Peak traffic periods, | 15 | | unless otherwise set by
municipal or county authority, are for | 16 | | the purposes of this Act declared to
be 7:30 a.m. o'clock to | 17 | | 9:00 a.m. o'clock in the forenoon, and from 4:30
p.m. o'clock | 18 | | to 6:00 p.m. o'clock in the afternoon, Monday through Friday
| 19 | | except for State and National holidays.

| 21 | | Section 99. Effective date. This Act takes effect upon | 22 | | becoming law.
