AMENDMENT TO HOUSE BILL 2322

2    AMENDMENT NO. ______. Amend House Bill 2322 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
514-1.09.2 as follows:
 
6    (105 ILCS 5/14-1.09.2)
7    Sec. 14-1.09.2. School Social Work Services. In the public
8schools, social work services may be provided by qualified
9specialists who hold Type 73 School Service Personnel
10Certificates endorsed for school social work issued by the
11State Teacher Certification Board or who hold a Professional
12Educator License with a school support personnel endorsement in
13the area of school social worker under Section 21B-25 of this
14Code.
15    School social work services may include, but are not
16limited to:

1        (1) Identifying students in need of special education
2    services by conducting a social-developmental study in a
3    case study evaluation;
4        (2) Developing and implementing comprehensive
5    interventions with students, parents, and teachers that
6    will enhance student adjustment to, and performance in, the
7    school setting;
8        (3) Consulting and collaborating with teachers and
9    other school personnel regarding behavior management and
10    intervention plans and inclusion in support of special
11    education students in regular classroom settings;
12        (4) Counseling with students, parents, and teachers in
13    accordance with the rules and regulations governing
14    provision of related services, provided that parent
15    permission must be obtained in writing before a student
16    participates in a group counseling session;
17        (5) Acting as a liaison between the public schools and
18    community resources;
19        (6) Developing and implementing school-based
20    prevention programs, including mediation and violence
21    prevention, implementing social and emotional education
22    programs and services, and establishing and implementing
23    bullying prevention and intervention programs;
24        (7) Providing crisis intervention within the school
25    setting;
26        (8) Supervising school social work interns enrolled in

1    school social work programs that meet the standards
2    established by the State Board of Education;
3        (9) Providing parent education and counseling as
4    appropriate in relation to the child's educational
5    assessment; and
6        (10) Assisting in completing a functional behavioral
7    assessment, as well as assisting in the development of
8    nonaversive behavioral intervention strategies; and .
9        (11) Evaluating program effectiveness.
10    Nothing in this Section prohibits other certified
11professionals from providing any of the services listed in this
12Section for which they are appropriately trained.

14    Section 10. The Children's Mental Health Act of 2003 is
15amended by changing Section 15 as follows:
 
16    (405 ILCS 49/15)
17    Sec. 15. Mental health and schools.
18    (a) The Illinois State Board of Education shall develop and
19implement a plan to incorporate social and emotional
20development standards as part of the Illinois Learning
21Standards for the purpose of enhancing and measuring children's
22school readiness and ability to achieve academic success. The
23plan shall be submitted to the Governor, the General Assembly,
24and the Partnership by December 31, 2004.

1    (b) Every Illinois school district shall develop a policy
2for incorporating social and emotional development into the
3district's educational program. The policy shall address
4teaching and assessing social and emotional skills and
5protocols for responding to children with social, emotional, or
6mental health problems, or a combination of such problems, that
7impact learning ability. School social workers may implement a
8continuum of social and emotional education programs and
9services in accordance with students' needs. Each district must
10submit this policy to the Illinois State Board of Education by
11August 31, 2004.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
