AMENDMENT TO HOUSE BILL 1817

2    AMENDMENT NO. ______. Amend House Bill 1817 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.826 as follows:
 
6    (30 ILCS 105/5.826 new)
7    Sec. 5.826. The Illinois Police Benevolent and Protective
8Association Fund.
 
9    Section 10. The Illinois Vehicle Code is amended by adding
10Section 3-699 as follows:
 
11    (625 ILCS 5/3-699 new)
12    Sec. 3-699. Illinois Police Benevolent and Protective
13Association license plates
14    (a) The Secretary, upon receipt of an application made in

1the form prescribed by the Secretary, may issue special
2registration plates designated as Illinois Police Benevolent
3and Protective Association license plates. The special plates
4issued under this Section shall be affixed only to passenger
5vehicles of the first division and motor vehicles of the second
6division weighing not more than 8,000 pounds. Plates issued
7under this Section shall expire according to the multi-year
8procedure established by Section 3-414.1 of this Code.
9    (b) The design and color of the plates is wholly within the
10discretion of the Secretary. The Secretary may allow the plates
11to be issued as vanity plates or personalized under Section
123-405.1 of the Code. The Secretary shall prescribe stickers or
13decals as provided under Section 3-412 of this Code. The
14Secretary may, in his or her discretion, allow the plates to be
15issued as vanity or personalized plates in accordance with
16Section 3-405.1 of this Code.
17    (c) An applicant for the special plate shall be charged a
18$25 fee for original issuance in addition to the appropriate
19registration fee. Of this fee, $10 shall be deposited into the
20Illinois Police Benevolent and Protective Association Fund and
21$15 shall be deposited into the Secretary of State Special
22License Plate Fund, to be used by the Secretary to help defray
23the administrative processing costs.
24    For each registration renewal period, a $25 fee, in
25addition to the appropriate registration fee, shall be charged.
26Of this fee, $23 shall be deposited into the Illinois Police

1Benevolent and Protective Association Fund and $2 shall be
2deposited into the Secretary of State Special License Plate
3Fund.
4    (d) The Illinois Police Benevolent and Protective
5Association Fund is created as a special fund in the State
6treasury. All money in the Illinois Police Benevolent and
7Protective Association Fund shall be paid, subject to
8appropriation by the General Assembly and distribution by the
9Secretary, as grants to the Illinois Police Benevolent and
10Protective Association for the purposes of providing death
11benefits for the families of police officers killed in the line
12of duty, providing scholarships for undergraduate study to
13children and spouses of police officers killed in the line of
14duty, and educating the public and police officers regarding
15policing and public safety.".
