AMENDMENT TO HOUSE BILL 1650

2    AMENDMENT NO. ______. Amend House Bill 1650, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, as follows:
 
5on page 1, by replacing line 5 as follows:
6"changing Sections 15-5 and 15-15 and by adding Section 15-155
7as follows:"; and
 
8on page 1, immediately below line 5, by inserting the
9following:
 
10    "(515 ILCS 5/15-5)  (from Ch. 56, par. 15-5)
11    Sec. 15-5. Commercial fisherman; license requirement.
12    (a) A "commercial fisherman" is defined as any individual
13who uses any of the commercial fishing devices as defined by
14this Code for the taking of any aquatic life, except mussels,
15protected by the terms of this Code.

1    (b) All commercial fishermen shall have a commercial
2fishing license. In addition to a commercial fishing license, a
3commercial fisherman shall also obtain a sport fishing license.
4All individuals assisting a licensed commercial fisherman in
5taking aquatic life, except mussels, from any waters of the
6State must have a commercial fishing license unless these
7individuals are under the direct supervision of and aboard the
8same watercraft as the licensed commercial fisherman. An
9individual assisting a licensed commercial fisherman must
10first obtain a sport fishing license.
11    (c) A "Lake Michigan commercial fisherman" is defined as an
12individual who resides in this State or an Illinois corporation
13who uses any of the commercial fishing devices as defined by
14this Code for the taking of aquatic life, except mussels,
15protected by the terms of this Code.
16    (d) For purposes of this Section, an act or omission that
17constitutes a violation committed by an officer, employee, or
18agent of a corporation shall be deemed the act or omission of
19the corporation.
