AMENDMENT TO HOUSE BILL 1155

2    AMENDMENT NO. ______. Amend House Bill 1155, AS AMENDED, by
3inserting the following in its proper numeric sequence:
 
4    "Section 3. Act implementation.
5    (a) Notwithstanding any other provision to the contrary,
6this Act shall be fully implemented no later than on January 1,
72016; however, the Act may be implemented and licenses to carry
8may be issued under this Act prior to January 1, 2016, if a
9report is issued to the General Assembly prior to January 1,
102016 from the Department of State Police, Department of Human
11Services, and Illinois Association of Circuit Court Clerks,
12indicating that the agencies and association have adopted,
13addressed, and remedied the findings of the Illinois Auditor
14General's Report from April 2012.
15    (b) The Illinois Auditor General's Report from April 2012
16indicated that there was a lack of reporting by circuit court
17clerks, with only 3 of 102 counties submitting mental health

1court orders to the Department of State Police as required by
2the Firearm Owners Identification Card Act, and that 27 of the
3121 orders that were issued by the circuit courts were not
4properly reported by the Department of State Police to the
5federal National Instant Criminal Background Check System
6(NICS) database. The report further indicated that the
7Department of Human Services did not properly distinguish
8between voluntary and involuntary admissions to mental health
9service facilities, and therefore the Department of State
10Police could not distinguish between disqualifying mental
11health admissions among persons possessing a Firearm Owner's
12Identification Card. Finally, among those persons possessing a
13Firearm Owner's Identification Card who did have
14disqualifications reported, only 30% of those persons
15disqualified under the Firearm Owners Identification Card Act
16actually returned their revoked Firearm Owner's Identification
17Cards to the Department of State Police. Implementation of this
18Act will present similar reporting issues and therefore cannot
19be effectively implemented until a remedy for the Firearm
20Owners Identification Card Act problems are completed and
21similar remedies can be applied to implementation of this Act.
22    (c) If no report is issued as provided under subsection (a)
23of this Section prior to January 1, 2016, the Department of
24State Police may not issue licenses to carry under this Act
25until on and after January 1, 2016.".
