SYNOPSIS AS INTRODUCED:
 
20 ILCS 405/405-335

    Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that the Illinois Transparency and Accountability Portal shall provide direct access to a database of all current State grants, sorted by grantee name, awarding agency, grant value, and the purpose for which the grant is awarded. Effective July 1, 2013.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-335 as follows:
 
7    (20 ILCS 405/405-335)
8    Sec. 405-335. Illinois Transparency and Accountability
9Portal (ITAP).
10    (a) The Department, within 12 months after the effective
11date of this amendatory Act of the 96th General Assembly, shall
12establish and maintain a website, known as the Illinois
13Transparency and Accountability Portal (ITAP), with a
14full-time webmaster tasked with compiling and updating the ITAP
15database with information received from all State agencies as
16defined in this Section. Subject to appropriation, the
17full-time webmaster must also compile and update the ITAP
18database with information received from all counties,
19townships, and municipalities.
20    (b) For purposes of this Section:
21    "State agency" means the offices of the constitutional
22officers identified in Article V of the Illinois Constitution,
23executive agencies, and departments, boards, commissions, and

1Authorities under the Governor.
2    "Contracts" means payment obligations with vendors on file
3with the Office of the Comptroller to purchase goods and
4services exceeding $10,000 in value (or, in the case of
5professional or artistic services, exceeding $5,000 in value).
6    "Appropriation" means line-item detail of spending
7approved by the General Assembly and Governor, categorized by
8object of expenditure.
9    "Individual consultants" means temporary workers eligible
10to receive State benefits paid on a State payroll.
11    "Recipients" means State agencies receiving
12appropriations.
13    (c) The ITAP shall provide direct access to each of the
14following:
15        (1) A database of all current State employees and
16    individual consultants, except sworn law enforcement
17    officers, sorted separately by:
18            (i) Name.
19            (ii) Employing State agency.
20            (iii) Employing State division.
21            (iv) Employment position title.
22            (v) Current pay rate and year-to-date pay.
23        (2) A database of all current State expenditures,
24    sorted separately by agency, category, recipient, and
25    Representative District.
26        (3) A database of all development assistance

1    reportable pursuant to the Corporate Accountability for
2    Tax Expenditures Act, sorted separately by tax credit
3    category, taxpayer, and Representative District.
4        (4) A database of all revocations and suspensions of
5    State occupation and use tax certificates of registration
6    and all revocations and suspensions of State professional
7    licenses, sorted separately by name, geographic location,
8    and certificate of registration number or license number,
9    as applicable. Professional license revocations and
10    suspensions shall be posted only if resulting from a
11    failure to pay taxes, license fees, or child support.
12        (5) A database of all current State contracts, sorted
13    separately by contractor name, awarding officer or agency,
14    contract value, and goods or services provided.
15        (6) A database of all employees hired after the
16    effective date of this amendatory Act of 2010, sorted
17    searchably by each of the following at the time of
18    employment:
19            (i) Name.
20            (ii) Employing State agency.
21            (iii) Employing State division.
22            (iv) Employment position title.
23            (v) Current pay rate and year-to-date pay.
24            (vi) County of employment location.
25            (vii) Rutan status.
26            (viii) Status of position as subject to collective

1        bargaining, subject to merit compensation, or exempt
2        under Section 4d of the Personnel Code.
3            (ix) Employment status as probationary, trainee,
4        intern, certified, or exempt from certification.
5            (x) Status as a military veteran.
6        (7) A searchable database of all current county,
7    township, and municipal employees sorted separately by:
8            (i) Employing unit of local government.
9            (ii) Employment position title.
10            (iii) Current pay rate and year-to-date pay.
11        (8) A searchable database of all county, township, and
12    municipal employees hired on or after the effective date of
13    this amendatory Act of the 97th General Assembly, sorted
14    separately by each of the following at the time of
15    employment:
16            (i) Employing unit of local government.
17            (ii) Employment position title.
18            (iii) Current pay rate and year-to-date pay.
19        (9) A database of all current State grants, sorted
20    separately by grantee name, awarding agency, grant value,
21    and the purpose for which the grant is awarded.
22    (d) The ITAP shall include all information required to be
23published by subsection (c) of this Section that is available
24to the Department in a format the Department can compile and
25publish on the ITAP. The Department shall update the ITAP as
26additional information becomes available in a format that can

1be compiled and published on the ITAP by the Department.
2    (e) Each State agency, county, township, and municipality
3shall cooperate with the Department in furnishing the
4information necessary for the implementation of this Section
5within a timeframe specified by the Department.
6    (f) Each county, township, or municipality submitting
7information to be displayed on the Illinois Transparency and
8Accountability Portal (ITAP) is responsible for the accuracy of
9the information provided.

12    Section 99. Effective date. This Act takes effect July 1,
132013.
