AMENDMENT TO SENATE BILL 1840

2    AMENDMENT NO. ______. Amend Senate Bill 1840 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Comptroller Act is amended by adding
5Section 26 as follows:
 
6    (15 ILCS 405/26 new)
7    Sec. 26. Helping Hand Pet Owners Care Fund. The State
8Comptroller may establish and administer a Comptroller's
9Helping Hand Pet Owners Care Fund. The purpose of the Fund is
10to refund certain costs to qualified veterinarians who perform
11spay and neuter procedures on dogs and cats brought in by
12low-income residents. Such low-income participants shall be
13limited to those whose eligible income shall be no more than
14150% of the poverty level as defined by the Federal Poverty
15Guidelines (FPL).
16    The Comptroller shall reimburse qualified veterinarians

1for 50% of the cost of such procedure, up to $50 per procedure.
2The Comptroller shall adopt such rules and regulations as he or
3she deems necessary for the efficient administration and
4operation of the Helping Hand Pet Owners Care Fund and shall
5expend no more than 10% of funds received on administration of
6the program. The Comptroller shall conduct regular audits of
7pet shops to determine their compliance under item (e) of
8Section 3.15 of the Animal Welfare Act.
9    The Comptroller, in administering the Helping Hand Pet
10Owners Care Fund, may receive such funds paid into it according
11to the Animal Welfare Act.
 
12    Section 10. The State Finance Act is amended by adding
13Section 5.786 as follows:
 
14    (30 ILCS 105/5.786 new)
15    Sec. 5.786. The Helping Hand Pet Owners Care Fund.
 
16    Section 15. The Animal Welfare Act is amended by changing
17Section 3.15 as follows:
 
18    (225 ILCS 605/3.15)
19    Sec. 3.15. Disclosures for dogs and cats being sold by pet
20shops.
21    (a) Prior to the time of sale, every pet shop operator
22must, to the best of his or her knowledge, provide to the

1consumer the following information on any dog or cat being
2offered for sale:
3        (1) The retail price of the dog or cat, including any
4    additional fees or charges.
5        (2) The breed, age, date of birth, sex, and color of
6    the dog or cat.
7        (3) The details of any inoculation or medical treatment
8    that the dog or cat received while under the possession of
9    the pet shop operator.
10        (4) The name and business address of both the dog or
11    cat breeder and the facility where the dog or cat was born.
12    If the dog or cat breeder is located in the State, then the
13    breeder's license number. If the dog or cat breeder also
14    holds a license issued by the United States Department of
15    Agriculture, the breeder's federal identification number.
16        (5) Any known congenital or hereditary diseases of the
17    parents of the dog or cat, or the parents' other offspring.
18        (6) If eligible for registration with a pedigree
19    registry, then the name and registration numbers of the
20    sire and dam and the address of the pedigree registry where
21    the sire and dam are registered.
22        (7) If the dog or cat was returned by a customer, then
23    the date and reason for the return.
24        (8) The following written statement: "A copy of our
25    policy regarding warranties, refunds, or returns is
26    available upon request.".

1        (9) The pet shop operator's license number issued by
2    the Illinois Department of Agriculture.
3    (b) The information required in subsection (a) shall be
4provided to the customer in written form by the pet shop
5operator and shall have an acknowledgement of disclosures form,
6which must be signed by the customer and the pet shop operator
7at the time of sale. The acknowledgement of disclosures form
8shall include the following:
9        (1) A blank space for the dated signature and printed
10    name of the pet shop operator, which shall be immediately
11    beneath the following statement: "I hereby attest that all
12    of the above information is true and correct to the best of
13    my knowledge.".
14        (2) A blank space for the customer to sign and print
15    his or her name and the date, which shall be immediately
16    beneath the following statement: "I hereby attest that this
17    disclosure was posted on or near the cage of the dog or cat
18    for sale and that I have read all of the disclosures. I
19    further understand that I am entitled to keep a signed copy
20    of this disclosure.".
21    (c) A copy of the disclosures and the signed
22acknowledgement of disclosures form shall be provided to the
23customer at the time of sale and the original copy shall be
24maintained by the pet shop operator for a period of 2 years
25from the date of sale. A copy of the pet store operator's
26policy regarding warranties, refunds, or returns shall be

1provided to the customer.
2    (d) A pet shop operator shall post in a conspicuous place
3in writing on or near the cage of any dog or cat available for
4sale the information required by subsection (a) of this Section
53.15.
6    (e) A pet shop shall collect $15 for each dog or cat sold.
7The money shall be sent quarterly to the Illinois Comptroller
8and be deposited in the Helping Hand Pet Owners Care Fund. The
9Comptroller shall distribute the proceeds of this fee to
10qualified veterinarians who perform spay and neuter procedures
11on dogs and cats brought in by low-income residents.
