AMENDMENT TO SENATE BILL 1694

AMENDMENT NO. ______. Amend Senate Bill 1694 on page 7, by replacing lines 16 through 25 with the following:

"(a) A deceased person's health care records may be released as authorized by Section 8-802, to the executor or administrator of the person's estate, or to an agent appointed under a power of attorney for health care. When no executor, administrator, or agent exists, and the deceased has not specifically objected to disclosure of his or her records in writing, then a surviving spouse may make a written request for a copy of the deceased spouse's records."; and

on page 8, by replacing line 1 with the following:

"If there is no surviving spouse,"; and

on page 8, by replacing lines 3 and 4 with the following: "written request for a copy of the deceased patient's records:"; and

on page 9, line 7, by replacing "estate or" with "estate,"; and

on page 9, line 8, by adding before the period ", and the deceased has not specifically objected to disclosure in writing".
