AMENDMENT TO SENATE BILL 1306

2    AMENDMENT NO. ______. Amend Senate Bill 1306 as follows:
 
3on page 6, by replacing lines 19 through 23 with the following:
4    "(a) The Commission may adopt any rules and procedures
5necessary to enforce and administer the provisions of this
6Act."; and
 
7on page 8, line 2, by replacing "$5.50" with "$10"; and
 
8on page 8, by replacing lines 16 and 17 with the following:
9    "(a) It shall be unlawful for any person or entity to
10repossess"; and
 
11on page 8, by replacing lines 22 and 23 with the following:
12    "(b) It shall be unlawful for any person to repossess a
13vehicle"; and

1on page 9, by replacing lines 2 through 3 with the following:
2    "(c) It shall be unlawful for any person to repossess a
3vehicle"; and
 
4on page 13, line 1, after "Commission.", by inserting the

6"It shall be unlawful for any person or entity to repossess a
7vehicle or collateral in the State without a recovery ticket
8issued by the Commission."; and
 
9on page 13, line 9, after "Act.", by inserting the following:
10"State, county, and local municipalities shall work in
11conjunction with the Commission in the enforcement of this
12Act."; and
 
13on page 21, by replacing lines 17 and 18 with the following:
14    "(a) The license and permit fees required under this Act
15are as follows:"; and
 
16on page 35, line 16, by deleting "No fee may be"; and
 
17on page 35, by deleting lines 17 and 18; and
 
18on page 35, by replacing lines 21 through 23 with the
19following:

10disciplinary action that the Commission may deem proper if a
11person or entity repossesses a vehicle or collateral in the
12State without a valid license and permit. For all other
13disciplinary actions against a license or recovery permit
14holder, the Commission shall (i) notify the accused in writhing
15of any charges made and the time and place for a hearing on the
16charges a least 30 days before the date set for the hearing,
17(ii) direct the accused to file a"; and
 
18on page 49, by replacing lines 6 and 7 with the following:
19    "Section 999. Effective date. This Act takes effect on July
201, 2012.".
