AMENDMENT TO SENATE BILL 965

2    AMENDMENT NO. ______. Amend Senate Bill 965, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
41, on page 12, line 10, by deleting "or county"; and
 
5on page 18, lines 13 and 14, by replacing "every 60 days" with
6"each week"; and
 
7on page 18, line 15, after "year.", by inserting the following:
8"Radar equipment shall be checked for accuracy by a qualified
9technician when the unit is serviced, when unusual or suspect
10readings persist, or when deemed necessary by a reviewing
11technician. Radar equipment shall be checked with certified
12tuning forks, the internal circuit test, and diode display test
13whenever the radar is turned on. Technicians must be alert for
14any unusual or suspect readings, and if unusual or suspect
15readings of a radar unit persist, that unit shall be
16immediately be removed from service and not returned to service

1until it has been checked by a qualified technician and
2determined to be functioning properly."; and
 
3on page 41, by replacing lines 15 through 19 with the
4following:
5"mile from the nearest property line of any public or private
6elementary or secondary school, or from the nearest property
7line of any facility, area, or land owned by a school district
8that is used for educational purposes approved by the Illinois
9State Board of Education, not including school district
10headquarters or administrative buildings. A safety zone also
11includes an area that is within one-eighth of a mile from the
12nearest property line of any facility, area, or land owned by a
13park district used for recreational purposes. However, if any
14portion of a roadway is within either one-eighth mile radius,
15the safety"; and
 
16on page 41, by inserting immediately below line 24 the
17following:
18    "(a-5) The automated speed enforcement system shall be
19operational and violations shall be recorded only at the
20following times:
21        (i) if the safety zone is based upon the property line
22    of any facility, area, or land owned by a school district,
23    on school days no earlier than 6 a.m. and no later than 10
24    p.m.; and

1        (ii) if the safety zone is based upon the property line
2    of any facility, area, or land owned by a park district, no
3    earlier than one hour prior to the time that the facility,
4    area, or land is open to the public or other patrons, and
5    no later than one hour after the facility, area, or land is
6    closed to the public or other patrons."; and
 
7on page 42, line 19, after "violation.", by inserting the
8following:
9"No penalty may be imposed under this Section if the recorded
10speed of a vehicle is 5 miles per hour or less over the legal
11speed limit. The municipality may send, in the same manner that
12notices are sent under this Section, a speed violation warning
13notice where the violation involves a speed of 5 miles per hour
14or less above the legal speed limit.".
