| 2 | | AMENDMENT NO. ______. Amend Senate Bill 40, AS AMENDED, by | 3 | | replacing everything after the enacting clause with the | 4 | | following:
| 5 | | "Article 1. | 6 | | Section 1-5. The Military Code of Illinois is amended by | 7 | | changing Section 56-1 and by adding Section 56-2 as follows:
| 8 | | (20 ILCS 1805/56-1) (from Ch. 129, par. 220.56-1)
| 9 | | Sec. 56-1. Federal Support Agreement Revolving Fund; | 10 | | payment; use. The Federal Support Agreement Revolving Fund | 11 | | shall be initially financed
by an appropriation from the | 12 | | General Revenue Fund to the Federal Support
Agreement Revolving | 13 | | Fund. Thereafter, all monies received from the federal
| 14 | | government that are necessary for the reimbursement of salaries
| 15 | | paid to employees hired in reimbursed positions, for facility |

| 1 | | operations or
other programs as provided under the terms of the | 2 | | Federal Support Agreement
between the Department of Military | 3 | | Affairs and the United States Property and
Fiscal Officer for | 4 | | Illinois shall be paid into the Federal Support Agreement
| 5 | | Revolving Fund. The money in this fund shall be used by the | 6 | | Department of
Military Affairs only for those expenses | 7 | | necessary to meet all of the terms and
obligations of the | 8 | | Federal Support Agreement , except as otherwise provided in this | 9 | | Section . At the request of the Adjutant General, the State | 10 | | Treasurer and the State Comptroller shall transfer to the | 11 | | Illinois National Guard State Active Duty Fund from the Federal | 12 | | Support Agreement Revolving Fund the reimbursement from the | 13 | | federal government for State Fiscal Year 2011 expenditures from | 14 | | the General Revenue Fund in excess of $2,200,000 for expenses | 15 | | related to the Lincoln's Challenge Program. All moneys expended | 16 | | by the
Department of Military Affairs from the Federal Support | 17 | | Agreement Revolving Fund this Fund shall be appropriated by the
| 18 | | General Assembly.
Furthermore, any moneys that are | 19 | | appropriated to pay for weekly allowances
for students in the | 20 | | Lincoln's Challenge Program may be deposited by the
Department | 21 | | of Military Affairs into a savings and loan association or | 22 | | State or
national bank in this State. Such funds shall be | 23 | | managed by the Department of
Military Affairs in the manner | 24 | | provided by the laws of this State, applicable
rules and | 25 | | regulations based thereon, and applicable federal requirements
| 26 | | governing the use of such funds.

| 2 | | (20 ILCS 1805/56-2 new) | 3 | | Sec. 56-2. Illinois National Guard State Active Duty Fund; | 4 | | payment; use. The Illinois National Guard State Active Duty | 5 | | Fund is created and shall be initially financed by a transfer | 6 | | from the Federal Support Agreement Revolving Fund to the | 7 | | Illinois National Guard State Active Duty Fund as provided in | 8 | | Section 56-1 of this Code. Thereafter, all monies received from | 9 | | any government entity that reimburse costs incurred in the | 10 | | performance of State Active Duty shall be paid into the | 11 | | Illinois National Guard State Active Duty Fund. Disbursement | 12 | | from the Fund for purposes as set forth in this Section shall | 13 | | be by voucher ordered by the Adjutant General and paid by a | 14 | | warrant drawn by the State Comptroller and countersigned by the | 15 | | State Treasurer. The Director shall order disbursements from | 16 | | the Illinois National Guard State Active Duty Fund only for | 17 | | payment of expenses necessary to support the Illinois National | 18 | | Guard in the performance of State Active Duty. Monies in this | 19 | | Fund shall not be subject to appropriation by the General | 20 | | Assembly, but shall be subject to audit by the Auditor General. | 21 | | Article 5.
