AMENDMENT TO HOUSE JOINT RESOLUTION

CONSTITUTIONAL AMENDMENT 49

3    AMENDMENT NO. ___. Amend House Joint Resolution
4Constitutional Amendment 49 as follows:
 
5on page 1, line 9, by replacing "Section 5.1" with "Sections
65.1 and 5.2"; and
 
7on page 4, immediately after line 12, by inserting the
8following:
 
9      "(ILCON Art. XIII, Sec. 5.2 new)
10SECTION 5.2. INDEPENDENT ACTUARIAL REVIEW OF PENSION
11LEGISLATION
12    (a) After consulting with the Treasurer, the Comptroller
13shall appoint an independent actuary who shall conduct, at the
14request of the sponsor of a bill that amends the Illinois
15Pension Code or the State Pension Funds Continuing

1Appropriation Act (other than a bill limited to the subject of
2appropriations or for the codification, revision or
3rearrangement of laws), an assessment of that measure in order:
4(i) to estimate its impact on each affected public pension and
5retirement system, in dollars where appropriate and (ii) to
6identify its immediate effect and, if determinable or
7reasonably foreseeable, its long-range effect. If, after
8careful investigation, it is determined that no dollar estimate
9is possible, the independent actuary shall include in his or
10her assessment a statement to that effect, setting forth the
11reasons why no dollar estimate can be given. As soon as
12possible after completing each assessment, the independent
13actuary shall deliver a copy of the assessment to the
14Comptroller, Treasurer, Clerk of the House of Representatives,
15and Secretary of the Senate.
16    (b) A bill that amends the Illinois Pension Code or the
17State Pension Funds Continuing Appropriation Act may not be
18considered on the floor of the House of Representatives or the
19Senate until the independent actuary has delivered a copy of
20the assessment of that bill to the Comptroller, Treasurer,
21Clerk of the House of Representatives, and Secretary of the
22Senate.".
