1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Plumbing License Law is amended by
5changing Section 35 as follows:
 
6    (225 ILCS 320/35)  (from Ch. 111, par. 1133)
7    Sec. 35. The Department shall promulgate and publish and
8may from time to time amend a minimum code of standards for
9plumbing and the fixtures, materials, design and installation
10methods of plumbing systems based upon the findings of the
11sciences of pneumatics and hydraulics, after consideration of
12the recommendations of the Plumbing Code Advisory Council. By
13January 1, 2013, the Plumbing Code Advisory Council shall
14recommend amendments to the existing minimum code of standards
15for plumbing and the fixtures, materials, design, and
16installation methods of plumbing systems to reflect advances in
17those technologies and methods that more efficiently utilize
18natural resources and protect public health. Upon
19consideration of those recommendations, the Department shall
20submit the amendments to the existing minimum code of standards
21to the Joint Committee on Administrative Rules by May 31, 2013.
22The Department may promulgate and publish rules in the State's
23minimum code of standards for the minimum number of plumbing

1fixtures required for the comfort and convenience of workers
2and the public not inconsistent with, but not limited to, the
3requirements of the federal Americans With Disabilities Act,
4the Equitable Restrooms Act, and the U.S. Department of Labor,
5Office of Safety and Health Administration. The minimum code of
6standards for plumbing and any amendments thereto shall be
7filed with the Secretary of State as a public record. In
8preparing plumbing code standards and amendments thereto the
9Department may give consideration to the recommendations
10contained in nationally recognized plumbing codes and
11recommendations of nationally recognized material and
12equipment testing laboratories. The plumbing code promulgated
13by the Department under authority of this Act shall remain in
14effect as the minimum code authorized by this Act until the
15Department promulgates a new code under authority of this Act.
16At least 20 days' notice of a public hearing shall be given by
17the Department in a manner which the Department considers
18adequate to bring the hearing to the attention of persons
19interested in plumbing code standards. Notice of any public
20hearing shall be given by the Department to those who file a
21request for a notice of hearings.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.
