AMENDMENT TO HOUSE BILL 3849

2    AMENDMENT NO. ______. Amend House Bill 3849 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1517 as follows:
 
6    (625 ILCS 5/11-1517 new)
7    Sec. 11-1517. Electronic communication devices-bicyclists.
8    (a) As used in this Section:
9    "Electronic communication device" means an electronic
10device, including but not limited to a wireless telephone,
11personal digital assistant, or a portable or mobile computer
12while being used for the purpose of composing, reading, or
13sending an electronic message, but does not include a global
14positioning system or navigation system.
15    "Electronic message" means a self-contained piece of
16digital communication that is designed or intended to be

1transmitted between physical devices. "Electronic message"
2includes, but is not limited to electronic mail, a text
3message, an instant message, or a command or request to access
4an Internet site.
5    (b) A person may not ride a bicycle on a roadway, sidewalk,
6or bicycle path while using an electronic communication device
7to compose, send, or read an electronic message.
8    (c) This Section does not apply to:
9        (1) a law enforcement officer while performing his or
10    her official duties;
11        (2) a bicyclist using an electronic communication
12    device for the sole purpose of reporting an emergency
13    situation and continued communication with emergency
14    personnel during the emergency situation;
15        (3) a bicyclist using an electronic communication
16    device in hands-free or voice-activated mode; or
17        (4) a bicyclist using an electronic communication
18    device while stopped on the shoulder of a roadway.".
