AMENDMENT TO HOUSE BILL 3186

2    AMENDMENT NO. ______. Amend House Bill 3186 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Small
5Business Contracts Act.
 
6    Section 5. Definitions. For the purposes of this Act, the
7following terms shall have the following definitions:
8    "Small business" means a small business as defined in the
9Illinois Procurement Code.
10    "State contract" means a State contract, as defined in the
11Illinois Procurement Code, funded with State or federal funds,
12whether competitively bid or negotiated.
13    "State official or agency" means a department, officer,
14board, commission, institution, or body politic or corporate of
15the State.

1    Section 10. Award of State contracts.
2    (a) Not less than 10% of the total dollar amount of State
3contracts shall be established as a goal to be awarded to small
4businesses.
5    (b) The percentage in subsection (a) relates to the total
6dollar amount of State contracts during each State fiscal year,
7calculated by examining independently each type of contract for
8each State official or agency which lets such contracts.
 
9    Section 15. Compliance plans.
10    (a) Each State official or agency shall file with its
11respective chief procurement officer an annual compliance plan
12which shall outline the goals of the State official or agency
13for contracting with small businesses for the then current
14fiscal year, the manner in which the official or agency intends
15to reach these goals, and a timetable for reaching these goals.
16The chief procurement officer shall review and approve the plan
17of the State official or agency and may reject any plan that
18does not comply with this Act or any rules promulgated pursuant
19to this Act.
20    (b) Each State official or agency shall file with its
21respective chief procurement officer an annual report of its
22utilization of small businesses during the preceding fiscal
23year including lapse period spending and a mid-fiscal year
24report of its utilization to date for the then current fiscal
25year. The reports shall include a self-evaluation of the

1efforts of the State official or agency to meet its goals under
2the Act.
 
3    Section 20. Annual report. Each chief procurement officer
4shall file no later than March 1 of each year, an annual report
5that shall detail the level of achievement toward the goals
6specified in this Act over the 3 most recent fiscal years. The
7annual report shall include, but need not be limited to, the
8following:
9        (1) a summary detailing State appropriations subject
10    to the goals, the actual goals specified, and the goals
11    attained by each State official or agency;
12        (2) a summary of the number of contracts awarded and
13    the average contract amount by each State official or
14    agency; and
15        (3) an analysis of the level of overall goal
16    achievement concerning purchases from small businesses.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
