SYNOPSIS AS INTRODUCED:
 
410 ILCS 620/3.24 new
410 ILCS 620/28 new

    Amends the Illinois Food, Drug and Cosmetic Act. Provides that notwithstanding any provision of law, any person who is authorized to dispense prescription drugs in the State must accept, free of charge, expired or unwanted prescription drugs for proper disposal. Provides that the prescription drug dispenser shall make available to its customers or patients a container suitable for use as a receptacle that only permits for the deposit of items and the contents of which are locked and secured for the expired or unwanted prescription drugs. Provides that if a patient or customer is issued a prescription drug from a person who is authorized to dispense prescription drugs in the State and that prescription drug causes an adverse reaction and the patient or customer returns the remainder of the prescription drug to the dispenser, then the dispenser shall refund the full cost of the prescription drug to the patient or customer.

1    AN ACT concerning public health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Food, Drug and Cosmetic Act is
5amended by adding Sections 3.24 and 28 as follows:
 
6    (410 ILCS 620/3.24 new)
7    Sec. 3.24. Expired prescription drug disposal.
8Notwithstanding any provision of law, any person who is
9authorized to dispense prescription drugs in this State must
10accept, free of charge, expired or unwanted prescription drugs
11from a customer or patient for proper disposal. The
12prescription drug dispenser shall make available to its
13customers or patients a container suitable for use as a
14receptacle that only permits for the deposit of items and the
15contents of which are locked and secured for the expired or
16unwanted prescription drugs. The container shall be accessible
17to customers and patients and shall have posted clearly legible
18signage indicating that expired or unwanted prescription drugs
19may be disposed of in the container.
