AMENDMENT TO HOUSE BILL 2056

2    AMENDMENT NO. ______. Amend House Bill 2056, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, as follows:
 
5on page 1, line 4, by replacing "Section" with the following:
 
6    "Section 2. The Illinois Criminal Justice Information Act
7is amended by adding Section 9.3 as follows:
 
8    (20 ILCS 3930/9.3 new)
9    Sec. 9.3. The Prescription Pill and Drug Disposal Fund. The
10Prescription Pill and Drug Disposal Fund is created as a
11special fund in the State treasury. Moneys in the Fund shall be
12used for grants by the Illinois Criminal Justice Information
13Authority to local law enforcement agencies for the purpose of
14facilitating the collection, transportation, and incineration
15of pharmaceuticals from residential sources that are collected

1and transported by law enforcement agencies under Section 17.9A
2of the Environmental Protection Act. Interest attributable to
3moneys in the Fund shall be paid into the Fund.
 
4    Section"; and
 
5on page 11, by replacing lines 7 through 11 with the following:
6        "(22) the portion of a site or facility that is used to
7    incinerate only pharmaceuticals from residential sources
8    that are collected and transported by law enforcement
9    agencies under Section 17.9A of this Act."; and
 
10by replacing page 11, line 25, through page 12, line 20 with
11the following:
 
12    "(415 ILCS 5/17.9A new)
13    Sec. 17.9A. Collection and transportation of
14pharmaceuticals by law enforcement agencies. Notwithstanding
15any other provision of this Act, to the extent allowed by
16federal law, a law enforcement agency may collect
17pharmaceuticals from residential sources and transport them to
18an incinerator permitted by the Agency to be incinerated in
19accordance with the permit, permit conditions, this Act, and
20rules adopted under this Act. For the purposes of this Section,
21"law enforcement agency" means an agency of the State or of a
22unit of local of government which is vested by law or ordinance

1with the duty to maintain public order and to enforce criminal
2laws.".
