AMENDMENT TO HOUSE BILL 1948

2    AMENDMENT NO. ______. Amend House Bill 1948 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Criminal Justice Information Act
5is amended by adding Section 7.8 as follows:
 
6    (20 ILCS 3930/7.8 new)
7    Sec. 7.8. Surveillance cameras.
8    (a) By July 1, 2012, the Authority must (i) create a form
9for agencies to list the number of cameras that they own or
10have access to and (ii) post that form on the Authority's
11official Internet website.
12    (b) By December 31, 2012 and each December 1 thereafter,
13each agency that owns or has access to a camera shall provide
14to the Authority the following: (i) the completed form
15described in subsection (a) and (ii) a copy of any policies
16adopted by the agency that address camera use including: (A)

1policies that protect the privacy or civil liberties and rights
2of the general public, (B) minimal retention policies, (C)
3editing policies, (D) policies that address the sharing of data
4with other public and private entities, and (E) policies that
5restrict public access to data based upon a potential security
6compromise.
7    (c) By July 1, 2013 and each July 1 thereafter, the
8following information must be posted on the Authority's
9official Internet website for the prior calendar year: (i) all
10documents provided by an agency under subsection (b) and (ii) a
11list of agencies that own or have access to cameras and the
12number of cameras that each agency owns or has access to.
13    (d) This Section does not require an agency to disclose the
14location of any camera.
15    (e) For the purposes of this Section, "access" means
16real-time access to images from a camera.
17    For the purposes of this Section, "agency" means the
18following: (i) State agencies including all officers, boards,
19commissions, agencies, departments, committees, and
20authorities created by the Constitution, whether in the
21executive or legislative branch; (ii) municipalities and any
22other unit of local government; (iii) public institutions of
23higher learning as defined in Section 2 of the Higher Education
24Cooperation Act; (iv) school districts and public schools of
25this State including special charter districts, Department of
26Juvenile Justice School Districts, laboratory schools operated

1by the governing board of a public university, and alternative
2schools operated by a regional superintendent of schools; (v)
3boards of election commissioners; (vi) bodies politic and
4corporate of the State; (vii) administrative units or corporate
5outgrowths of State government created by or pursuant to
6statute; and (viii) all administrative units and corporate
7outgrowths of the entities described in this definition and as
8may be created by executive order of the Governor.
9    For the purposes of this Section, "camera" means any video
10surveillance camera that is located outdoors or within a public
11transit system. The term does not include a camera used
12principally to enforce traffic laws or to provide vehicle
13detection for traffic control devices or systems.".
