AMENDMENT TO HOUSE BILL 1948

2    AMENDMENT NO. ______. Amend House Bill 1948 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Criminal Justice Information Act
5is amended by adding Section 7.8 as follows:
 
6    (20 ILCS 3930/7.8 new)
7    Sec. 7.8. Surveillance cameras.
8    (a) By July 1, 2012, the Authority must (i) create a form
9for agencies to list the number of cameras that they own or
10have access to and (ii) post that form on the Authority's
11official Internet website.
12    (b) By December 31, 2012 and each December 1 thereafter,
13each agency that owns or has access to a camera shall provide
14to the Authority the following: (i) the completed form
15described in subsection (a) and (ii) a copy of any privacy
16policy adopted by the agency that addresses cameras for the

1purpose of protecting the privacy or other civil liberties and
2rights of the general public.
3    (c) By July 1, 2013 and each July 1 thereafter, the
4following information must be posted on the Authority's
5official Internet website for the prior calendar year: (i) any
6documents provided by an agency under subsection (b) and (ii) a
7list of agencies that own or have access to cameras and the
8number of cameras that each agency owns or has access to.
9    (d) For the purposes of this Section, "access" means
10real-time access to images from a camera.
11    For the purposes of this Section, "agency" means all units
12of government, including, but not limited to, the departments,
13boards, bureaus, committees, commissions, or any another
14subdivision of a State agency, unit of local government, public
15university or college, school district, or any other political
16entity.
17    For the purposes of this Section, "camera" means any video
18surveillance camera that is located outdoors or within a public
19transit system. The term does not include a camera used
20principally to enforce traffic laws or to provide vehicle
21detection for traffic control devices or systems.
22    For the purposes of this Section, "privacy policy" means
23any written regulations, policies, or ordinances, including,
24but not limited to, regulations, policies, or ordinances
25addressing the length of time that the agency retains camera
26images, the types of camera images that the agency retains, and

1the circumstances in which the agency discloses camera images
2to third parties.".
